Minister of Natural Resources and Environment discusses issuing land certificates for undocumented land

Under the new regulation, land without documents will be granted a red certificate when the authorities confirm that there is no dispute.

On February 19, the Office of the President held a press conference to announce the President’s proclamation of the Land Law (amendment), which was passed by the National Assembly at its fifth extraordinary session.

According to Mr. Le Minh Ngan, Deputy Minister of Natural Resources and Environment (MNRE), land without documents will be granted a land use right certificate (red book) if it meets the conditions stipulated in Article 3 of Article 138 of the Land Law 2024.

Households and individuals using land from October 15, 1993, to before July 1, 2014, without documents on land use rights, and without violating land laws, and not falling under the cases of land improperly allocated, will be granted a red book if they meet the conditions and if the People’s Committee at the commune level of the place where the land is located confirms that there is no dispute.

Mr. Le Minh Ngan said that this regulation is based on practical grounds and meets the requirements of land management. The Deputy Minister of MNRE emphasized the requirement to ensure “no disputes” when granting red books.

To implement this, Mr. Le Minh Ngan said that the role of land management officials at the local level is very important, as they are familiar with changes, land use conditions, or disputes.

Regarding concerns from the press about how to facilitate the procedure for granting red books to land without documents, Deputy Minister Le Minh Ngan said that the regulations in the law are the first step, and the process of implementation is very important, alongside the legal compliance awareness of the people.

Regarding the requirement for determining land without disputes, Mr. Ngan said that local authorities need to carefully consider this matter. In the future, the MNRE will develop a draft decree, which includes provisions on the procedures for granting red books for land without documents, to minimize inconvenience for the people.

“In addition, people also need to enhance their legal compliance and propose red book issuance in accordance with regulations and policies,” Mr. Le Minh Ngan emphasized.

The Land Law will take effect from January 1, 2025.
