What types of land without documents will be granted red book from 1/1/2025?

Deputy Minister of Natural Resources and Environment Le Minh Ngan said that the new Land Law will take effect from 1/1/2025, in which different groups will be considered eligible for the issuance of land use right certificates (red books) for land without documents.

Specifically, households and individuals using land before December 18, 1980, are now granted by the commune People’s Committee where the land is confirmed to have no disputes. Households and individuals using land from December 18, 1980, to before October 15, 1993, are now granted by the commune People’s Committee where the land is confirmed to have no disputes. Households and individuals using land from October 15, 1993, to before July 1, 2014, are now granted by the commune People’s Committee where the land is confirmed to have no disputes.

“In the process of granting red books, especially in cases where there are no documents on land use rights, reliance on actual land use, land management history is extremely important. It must be affirmed that when issuing certificates to citizens, disputes and complications should not occur. At the same time, only officials directly involved with the people, directly in control of the land fund in the locality, directly managing the changes in land throughout the history of land use can understand this. In which, it must be ensured that the land is dispute-free and stable. Stable means using for a specific purpose, for a certain period of time,” shared Deputy Minister of Natural Resources and Environment.

According to Deputy Minister of Natural Resources and Environment, the new Land Law will facilitate the issuance of red books to citizens, specify new conditions on policies, and the rest is the organization of implementation and awareness of legal compliance by citizens.

To implement this policy well, according to Deputy Minister Le Minh Ngan, three elements must be ensured. Specifically, the legal element must have stable land use, without disputes, confirmed by the commune People’s Committee. Next is the implementation element, in which local authorities, the Fatherland Front, and even inspection and inspection agencies must consider whether the implementation causes difficulties for the people: “This cannot be specifically regulated in the law. But in Decree, it will put into the procedure, procedures for issuing red books in this case to minimize difficulties and inconveniences for the people.”

Furthermore, Deputy Minister Le Minh Ngan clearly pointed out that the awareness of the people must ensure that the proposal for issuing red books complies with the law, without causing social conflicts in the process of implementing policies: “This is a very good policy that inherits the previous Land Law and based on current practice to have that policy. We will try to improve the policies under the law, at the same time, with the responsibility of state management agencies at the central level will cooperate with relevant agencies to supervise the implementation of policies well.”

Maintain the new land price table to be issued annually.

Regarding the issuance of the land price table, which will take effect from 1/1/2026, according to Deputy Minister Le Minh Ngan, after a very careful evaluation, through many meetings, analysis, the National Assembly has approved and maintained the plan as proposed, that is, the land price table will be issued annually.

Regarding the preparation of the foundation for building the land price table in the context of removing the land price frame for the policy to truly come into practice, avoiding congestion, and also from the time the law is passed until the new land price table is issued (1 /1/2026) would take nearly 2 years, Deputy Minister Le Minh Ngan affirmed that specific regulations have been made in the transition process.

Accordingly, in 2025, the land price table of the 2013 Land Law will still be used, adjusted and supplemented to ensure conformity with the market price of land according to the valuation principles of this law.

To prepare thoroughly for the new land price table from 1/1/2026, the law has stipulated that the land price table be determined by region, location. In which, for areas, localities that have cadastral maps, land price database, the land price table will determine to specific plots of land, based on the value of that plot of land. Along with that, encouraging localities to increase investment in funding, human resources, solutions … to build land databases in accordance with the principles and laws.
