Government Discussing Proposal for Amended Railway Law

On February 27th, Prime Minister Pham Minh Chinh chaired a special Government meeting on the construction of legislation in February 2024.

During the session, the Government considered and reviewed 11 items, including 6 draft laws, 4 proposals for law construction, and a proposal for the Program for Law and Ordinance Construction.

Specifically, the 6 discussed draft laws are as follows: Government’s Draft Law on Civil Aviation; Draft Law on the Management, Use of Weapons, Explosive Materials, and Support Tools (amendment); Draft Law on Cultural Heritage (amendment); Draft Law on Geology and Minerals; Draft Law to amend and supplement some articles of the Law on Standards and Technical Specifications; Draft Law to amend and supplement some articles of the Law on Pharmacy.

The 4 proposals for law construction include: Proposal for the Construction of the Law on Diplomatic Missions; Proposal for the Construction of the Law on Aviation (amendment); Proposal for the Construction of the Law on Railways (amendment); Proposal for the Construction of the Law on Digital Industry.

In his opening remarks, Prime Minister Pham Minh Chinh emphasized that in recent times, functional agencies have made many efforts and achieved many results in building and perfecting institutions. However, some regulations have been surpassed by reality; many emerging fields require regulations of laws to regulate.

To ensure progress and improve quality, the Prime Minister requested that all agencies involved in drafting laws and proposals for law construction must directly lead the construction process. Additionally, the Prime Minister demanded that all agencies allocate competent, knowledgeable, and dedicated personnel for the construction and improvement of institutions. In addition, he stressed the need to review the regime and policies to ensure appropriateness for the officials involved in this work, as investing in institutional building is an investment in development.

During the process of building draft laws and proposals for law construction, the Prime Minister emphasized that opinions should be collected only once from relevant ministries, ministerial-level agencies, and government agencies. If there are any differing opinions, the Deputy Prime Minister in charge should convene a meeting with the relevant agencies to resolve them immediately.

With the spirit of “identifying difficulties and resolving them, addressing issues at the appropriate level,” the Prime Minister suggested that agencies continue to review and propose authorized levels to amend and supplement regulations to ensure clarity, rigor, transparency, publicity, practicality, simplicity, ease of implementation, inspection, supervision, and evaluation. This way, the subjects who enforce and comply with the law can confidently carry out their duties.

The head of the Government emphasized that practice shows that if the preparation of legal normative documents is done well, with careful
planning of the situation and forecasting, then the regulations and policies will be effective immediately after issuance, resolving difficulties and issues. However, if the preparation is not done well, then revisions and supplements are necessary as soon as the documents are completed.
