Illegal Land Transfer: Arresting the Village Chairman and 4 Officials

The Chairman and Vice Chairman of a commune in Hung Ha district, Thai Binh province, have recently been arrested and detained in connection with illegal transfer of land use rights for rice cultivation.

On February 27, the Police Department of Thai Binh province announced that the Criminal Investigation Agency of Hung Ha district has initiated a case, prosecuting and temporarily detaining the Chairman and Vice Chairman of the People’s Committee of Hong An commune, along with 3 other individuals involved in the “Abuse of power in the performance of official duties” case.

The defendants include: Duong Khac Thuy (born in 1965, Chairman of the People’s Committee of Hong An commune); Tran Huu Dung (born in 1981, Vice Chairman of the People’s Committee of Hong An commune, former official of the commune’s land department); Tran Ich Vinh (born in 1964, Secretary of the Party Cell of Bac Son hamlet, Hong An commune); Tran Quang Bao (born in 1964, head of Bac Son hamlet, Hong An commune) and Duong Thi Hoa (born in 1968, chairwoman of the Women’s Union of Bac Son hamlet, Hong An commune).

The above decisions and orders have been approved by the District Prosecutor’s Office of Hung Ha.

Through the investigation process, it was determined that in 2018, the above defendants exceeded their delegated authority by illegally transferring the right to use 5,269.4 square meters of paddy land in Dong Linh Mau, Dong Trang hamlet, Hong An commune, Hung Ha district.

The actions of the defendants caused damage to the state and individuals in the total amount of over 221 million VND.

The Criminal Investigation Department of the Hung Ha District Police is continuing to investigate and handle the individuals according to the provisions of the law.

In September 2023, the Criminal Investigation Agency of Dong Hung district (Thai Binh province) also initiated charges against the chairman and officials of the land administration, agriculture, construction, and environment department of Dong A commune.

The defendants who were charged include: Phi Duc Vui (born in 1969, residing in Dong A commune, Dong Hung district, Chairman of Dong A commune People’s Committee) charged with “Violation of regulations on accounting resulting in serious consequences” under paragraph 2, Article 221; “Abuse of position and powers while performing official duties” under paragraph 2, Article 356 of the Criminal Code; Le Van Luy (born in 1965, residing in Dong A commune, Dong Hung district, official of the land administration, agriculture, construction, and environment department of Dong A commune).

Through the investigation, it was determined that as Chairman of Dong A commune People’s Committee, Phi Duc Vui directed the commune’s accounting department to keep more than 1 billion VND outside the accounting system.

Further investigation revealed that Phi Duc Vui and Le Van Luy fabricated documents in November 2021 and June 2022 to withdraw money from the budget of Dong A commune, causing damage of over 23 million VND.
