The Ministry of Natural Resources and Environment just submitted a report to Deputy Prime Minister Tran Hong Ha regarding the construction and proposal of the National Assembly’s Resolution on “Piloting the implementation of commercial housing projects through agreements on land use rights or existing land use rights for other purposes”.
According to the Ministry, the draft resolution contains 2 policies. Firstly, it allows real estate businesses to transfer the right to use various types of land according to the regulations in Article 9 of the Land Law 2024, provided they meet the conditions to carry out commercial housing projects.

Secondly, it allows real estate businesses with land use rights to carry out commercial housing projects on other types of land that are not designated for housing, as specified in Article 9 of the Land Law 2024.
According to the draft, the types of land to be implemented are those that have received the transfer of land use rights for the implementation of commercial housing projects, including types of land specified in Article 9 of the Land Law 2024 that meet the conditions for transferring land use rights. In addition, investors have land types specified in Article 9 of the Land Law 2024.
The applicable subjects are real estate businesses, land users as prescribed by the Land Law, and state agencies, organizations managing land that has not been allocated, leased, or has been allocated for management.
The pilot project will be implemented for a period of 5 years, from January 1, 2025, to January 1, 2030.
