Abandoned steel sheet project terminated after decades on precious land in Thai Nguyen

After a prolonged delay, the construction investment project of Taipei Hotel in the prime location of the city center of Thai Nguyen has been revoked by the local authorities.

The People’s Committee of Thai Nguyen province has issued Decision 325 on the revocation of land belonging to Da Bac TNKS Investment Joint Stock Company on Phan Dinh Phung Street, Thai Nguyen city, for violating land laws.

Specifically, Thai Nguyen province has revoked 8,288.0m2 of land, belonging to land plot number 601, map sheet number 42, in Phan Dinh Phung ward. The land was leased by Thai Nguyen province according to Decision 2636 dated November 9, 2012, and a land use certificate was issued under the number BP 079496 on August 10, 2015.

The reason for the revocation is the investor’s failure to put the land into use to implement the Da Bac Hotel construction project within the continuous 12-month period starting from the date of land handover on site, and failure to follow the procedures for extending the land use period as specified by the law (the time for not using the land from the date of land handover on site to the date the Department of Natural Resources and Environment issued Inspection Conclusion number 69 on October 27, 2023 is 111 months and 20 days, and until February 20, 2024 is 115 months and 13 days), in violation of the Land Law.

To ensure the land revocation is in accordance with the law, Thai Nguyen province has assigned the Department of Finance to take charge, coordinate with the Department of Natural Resources and Environment, the Tax Department of Thai Nguyen province, the People’s Committee of Thai Nguyen city, and relevant units to inspect, determine, and handle financial obligations related to the Da Bac Hotel construction project in full compliance with the law. The city’s land fund development center will manage the 8,288.0m2 of land according to the plan.

The Department of Natural Resources and Environment will take charge of land revocation and handover on site as prescribed; revoke the land use certificate number BP 079496 issued by Thai Nguyen province on August 10, 2015 in the name of Da Bac TNKS Investment Joint Stock Company; and adjust the cadastral records as required by regulations.

The Chairman of Phan Dinh Phung ward’s People’s Committee is responsible for delivering this decision to Da Bac TNKS Investment Joint Stock Company. In case the company refuses to accept or is absent, a record must be made, and this decision must be posted at the headquarters of Phan Dinh Phung ward’s People’s Committee and at the Cultural House of Group 15, Phan Dinh Phung ward.

In particular, Da Bac TNKS Investment Joint Stock Company is responsible for handing over the original land use certificate number BP 079496 issued by Thai Nguyen province on August 10, 2015 to the Department of Natural Resources and Environment; and coordinating with the Department of Finance, the Tax Department, and relevant provincial departments to determine and perform financial obligations related to the Da Bac Hotel construction project.

According to research, the Da Bac Hotel construction project by Da Bac TNKS Investment Joint Stock Company has a total investment of 150 billion VND. The project was issued an investment certificate by Thai Nguyen province in 2009, the land was handed over in 2012, and the land use certificate was granted in 2015.
