The Government has issued Decree No. 21/2024/ ND-CP amending regulations on the determination of salary funds; salary scale, salary table, allowances for employees; amending regulations on salary ranking for managers and controllers.

Decree No. 21 of the Government amends and supplements some articles of Decree No. 51 and No. 52 signed on June 13, 2016, regulating the management of labor, salary, and bonuses for managers, employees working in the 100% state-owned LLC Company.

Amending regulations on salary scale, salary table, allowances for employees

Decree No. 21 amends Article 4 of Decree No. 51 regarding the salary scale, salary table, and allowances for employees working in the 100% state-owned LLC Company.

Specifically, based on production organization, labor organization, construction company, and the salary scale, salary table, and allowances issued to determine the salary, payroll, and implementation of regulations for employees under the labor law.

Calculation of pension benefits remains problematic

The salary levels in the salary scale, salary table, and allowances are decided by the company, but must ensure that the salary funds calculated based on the salary levels in the salary scale, salary table, and allowances do not exceed the planned salary funds of the employees as regulated.

When constructing or amending, supplementing the salary scale, salary table, and allowances, the company must consult the opinions of the organization representing the employees at the grassroots level, conduct dialogues at the workplace according to regulations, report to the representative agency of the owner for approval and publicly announce at the company before implementation.

Amending, supplementing regulations on the determination of planned salary funds

Decree No. 21 also amends, supplements points a and b, clause 3, Article 5 of Decree No. 51 regarding the determination of planned salary funds.

Specifically, when determining the planned salary funds, the company excludes objective factors that affect labor productivity and the planned profit compared to the previous year’s performance.

The salary and bonuses for employees working in the 100% state-owned LLC Company will change.

Amending regulations on salary ranking for managers, controllers

Decree No. 21 also amends and supplements Decree No. 52, which regulates salaries, allowances, and bonuses for managers of the 100% state-owned LLC Company.

Specifically, the phrase “managers” in the name and the phrases “managers” or “company managers” are replaced by the phrase “managers, controllers”.

Regarding salary ranking for managers, controllers, under the new regulations in Decree No. 21, based on the management structure, the council members or the chairman of the company shall establish the salary scale and ranking for managers, controllers as a basis to implement social insurance, health insurance, unemployment insurance, and other regimes as regulated by labor law.

The salary levels in the salary table are decided by the council members or the chairman of the company, but must ensure that the salary funds calculated based on the salary levels in the salary table do not exceed the planned salary funds for managers, controllers as regulated.

Decree No. 21 also adds a provision: In case the control board of the company has only 1 controller as regulated in Article 103 of the Enterprise Law, the controller is entitled to salaries, remunerations, and bonuses for the position of the chief of the control board.
