The 22 Hilltop Villas: Signs of Relaxed Management

Regarding the construction of 22 villas on a hill in Loc Thanh commune, Bao Lam district, Lam Dong province, after inspection, the Department of Construction has reported to provincial leaders on issues of construction order and planning management.

The villas were built inappropriately in Thon 10A, Loc Thanh commune, Bao Lam district.

Accordingly, 22 houses here include 17 solid villas, 1 house with a steel frame, and 4 houses with foundations. All of them do not meet the regulations of the Housing Law and the Construction Law at this location.

Regarding land, after many divisions and mergers, in the land use conversion decisions of the Bao Lam District People’s Committee, it is stated that: “When building houses, contact the local construction management agency for guidance on procedures, comply with related planning”.

The Department of Construction said the reports of the Bao Lam District People’s Committee and the Loc Thanh Commune People’s Committee stated that the construction of the houses on the land area converted for use was exempted from construction permits.

However, after checking, the construction area of the 17 houses mentioned above does not correspond to the approved construction plan in the area (not yet planned as a rural residential area), and does not comply with the regulations of the Housing Law and the Construction Law.

The Loc Thanh Commune People’s Committee and the Bao Lam District People’s Committee have not strictly followed the provincial People’s Committee’s direction to suspend construction activities because the above area has not yet reached an agreement between the land use plan and the construction plan; there are signs of slack management of land and construction.

In addition, the Loc Thanh Commune People’s Committee and the Bao Lam District People’s Committee have not taken any drastic measures to prevent and handle the situation, so the above villas continued to be built after being inspected by functional agencies.

The Department of Construction also recommended that the Lam Dong Provincial People’s Committee direct the Bao Lam District People’s Committee to continue to strictly implement the direction of the Provincial People’s Committee, strengthen management, prevent similar violations in the district, and end the construction of works and houses that do not comply with the approved plan.

At the same time, the Lam Dong Department of Construction also proposed to complete the procedures for administrative handling of construction violations of the houses in the above area and take responsibility for resolving any consequences arising in accordance with the law. Delegate the Bao Lam District People’s Committee to organize an inspection and take disciplinary action against the leaders of Loc Thanh Commune People’s Committee and related organizations and individuals.

As reported by Nguoi Lao Dong newspaper, around May 2023, the Loc Thanh Commune People’s Committee inspected the construction on the hill in Thon 10A and recorded 18 construction works that had completed the rough part, and requested a temporary suspension of construction. Until October 2023, the commune continued to inspect and found that the construction was still ongoing and 4 more works had been added.

However, it was not until March 2024 that the commune reported to the Bao Lam District People’s Committee. The Loc Thanh commune government explained that due to the large area, heavy workload, and lack of staff, the situation could not be controlled. The violators, despite being issued fines, still secretly continued to build and complete the works on holidays, making it difficult for the authorities to manage; the violators were not locals.

The district People’s Committee later suspended Nguyen Ngoc Cau, Chairman of Loc Thanh Commune People’s Committee and Tran Ngoc Hoan, an official of the commune’s Land, Agriculture, Construction and Environment Department.
