The Ho Chi Minh City Urban Infrastructure Development Project Management Board, the investor of the infrastructure construction and upgrading of Tham Luong – Ben Cat – Rach Nuoc Len canal project, is scheduled to meet with Thuan An Corporation Joint Stock Company (Thuan An Corporation) on 22 April 2023, to discuss the possibility of ensuring the construction progress of packages XL-05 and XL-06.
Simultaneously, Thuan An must report in detail its construction implementation plan to ensure the completion of packages before 30 April 2025.
Thuan An, as part of a consortium, is involved in the implementation of these two packages, carrying out approximately 130 billion VND of the total contract value.
In package XL-05 (the section from Tan Ky – Tan Quy bridge to Bung bridge), according to the contract, Thuan An Corporation is in charge of constructing traffic roads and technical infrastructure (excluding green trees, lighting) on the right bank. The contract value of Thuan An Corporation’s part of the work is 77.5/561.5 billion VND, accounting for 13.8% of the package contract value.
Regarding the 2.8 km long XL-06 package (section from Bung bridge to Tham Luong bridge), Thuan An Corporation is a member of a consortium consisting of Thoi Binh Commercial Construction Joint Stock Company, Thanh Tuan Construction and Project Survey Limited Liability Company, Nguyen Le Construction Investment and Development Joint Stock Company, Cong Chanh Joint Stock Construction Company and Thuan An Corporation.
According to the contract, in package XL-06, Thuan An Corporation will construct traffic roads and technical infrastructure (excluding green trees, lighting) on the right bank. The work carried out has a volume of approximately 53.6 billion VND/458.3 billion VND, equivalent to 11.70% of the contract package.
As reported by VTC News on 18 April, the Ho Chi Minh City Urban Infrastructure Development Project Management Board sent an official letter to Thuan An Corporation Joint Stock Company regarding the implementation of contracts for packages XL-05 and XL-06 of the Tham Luong – Ben Cat – Rach Nuoc Len canal infrastructure construction and environmental improvement project.
According to the investor, after inspecting the construction sites of the two packages and receiving reports from the supervising consultant, it was found that Thuan An Corporation has currently suspended construction. The project management personnel and workers are not present on the construction site.
The investor requested Thuan An Corporation to issue an official letter clarifying its ability to continue performing the construction contract for the two packages. It should clearly state the company’s organizational structure, its legal representative, etc., and submit it to the Ho Chi Minh City Urban Infrastructure Development Project Management Board before 25 April.
If Thuan An Corporation does not respond, the Ho Chi Minh City Urban Infrastructure Development Project Management Board will consider it as a breach of contract and take appropriate action.
On 19 April, Thuan An Corporation sent an official letter to the Ho Chi Minh City Urban Infrastructure Management Board to respond regarding its ability to continue implementing the two aforementioned contracts.
In the letter, Thuan An Corporation committed to continuing the construction work it is responsible for in construction packages 5 and 6 and confirmed that it will not affect the overall project progress.
On 15 April, the Ministry of Public Security’s Investigation Police Agency issued a decision to prosecute and temporarily detain Nguyen Duy Hung, Chairman of Thuan An Corporation Joint Stock Company, to investigate the crime of “Violating bidding regulations causing serious consequences”.
The defendant Nguyen Duy Hung was arrested during the investigation by the Department of Investigation Police for Crimes of Corruption, Economic Crimes, and Smuggling (C03) into the case of “Violating bidding regulations causing serious consequences; Bribery; Receiving bribes” occurring at Thuan An Joint Stock Corporation and related units and organizations.
In the same case, C03 issued a decision to prosecute and temporarily detain Mr. Tran Anh Quang, General Director of Thuan An Joint Stock Corporation, for the crime of “Bribery”.
Mr. Nguyen Khac Man, Deputy General Director of Thuan An Corporation, was prosecuted by C03 and temporarily detained for the crime of “Violating bidding regulations causing serious consequences” and “Receiving bribes”.
