The Criminal Investigation Agency of the Ministry of Defense has just sent a Notice to Thanh An General Company, the Ministry of Defense; Ba Dinh Investment and Construction Consulting Joint Stock Company; International Holding Joint Stock Company; the whistleblower about the results of handling the source of information about the crime related to the Thanh An Tower project at No. 21 Le Van Luong (Nhan Chinh ward, Thanh Xuan district, Hanoi).

In the notice, the Criminal Investigation Agency of the Ministry of Defense said that it had previously received a criminal denunciation from some individuals who bought apartments in the Thanh An Tower project, requesting that the Ministry of Defense and relevant agencies verify the clarification of lax land management, capital management, and state assets, violations in project management and the responsibility of Thanh An General Company in selecting business partners; to strictly handle and resolve the investor’s violations; to withdraw the project from Thanh An General Company and Ba Dinh Company to hand it over to other units with sufficient capacity to implement; to clarify the responsibility of the banks for lending and disbursing loans to customers.
As a result of handling the criminal denunciation, initially, the Criminal Investigation Agency of the Ministry of Defense has issued a decision to prosecute the criminal case of “Violating regulations on land management” occurring at the Thanh An Tower project as prescribed in Clause 3, Article 229 of the Penal Code.
4 times of planning adjustment, changing the land of the agency into a high-rise building
Previously, the Inspectorate of the Ministry of Construction had concluded that there were many violations related to planning, planning adjustment, and construction management approved in the area on both sides of Le Van Luong Road (Hanoi), including the Thanh An Tower project at No. 21 Le Van Luong.

According to the inspection conclusion, Hanoi People’s Committee adjusted the planning 3 times, the Department of Planning and Architecture approved the master plan 1 time illegally, approved the master plan 1 time with additional administrative procedures when there was a detailed planning with sufficient conditions to approve investment and construction, grant the permit.
“The 4 illegal adjustments changed from the land of the agency for renovation and refurbishment (in 2002, 2006) to a 25-storey office agency (in 2008); into office, commercial services, and apartments for sale (in 2010), which increased the building land area from 6,107m2 to 6,146.95m2, increased the construction density from 40% to 51%, increased the number of floors from an average of 5 floors to 30 floors, increased the construction area from 2,443m2 to 3,145m2, the floor area increased from 12,214m2 to 76,140m2, and the population scale increased from 500 people to about 1,308 people (assuming 327 apartments for living x 4 people/apartment). The responsibility lies with the Department of Planning and Architecture, Hanoi People’s Committee”, the inspection conclusion stated.
According to records, the Thanh An Tower project in the “golden land” area at No. 21 Le Van Luong is still a concrete block lying “still” for many years. The initial investor of the project was Thanh An General Company, which later transferred cooperation with Ba Dinh Investment and Construction Consulting Joint Stock Company. In 2018, the project was renamed Manhattan Tower and the project development unit was also renamed – Landmark Holding Joint Stock Company, later renamed International Holding Joint Stock Company (LMH). |
