Request to Take Charge of Specialized Job Arrangements in Ho Chi Minh City

Ho Chi Minh City generates many job positions for civil servants and public employees that are really needed and suitable, but are not yet covered by the regulations of circulars from central ministries and sectors.

HCM City has reported to the Ministry of Home Affairs on the results of a proposed project to create job roles in administrative agencies and public career units under the People’s Committee of Ho Chi Minh City.

At the same time, the city has approved job roles at 8/33 public service units under the city and its departments and sectors; 1,245/1,432 public service units under the People’s Committees of districts, Thu Duc City.

The remaining agencies, units are currently under assessment.

Many necessary positions not yet defined

According to the People’s Committee of Ho Chi Minh City, the relevant ministries and departments have issued frameworks to define job roles for leaders, managers, professional technical staff at public career units.

However, during the construction of the job role project over the past period under the general direction of the government, there are still some concerns about job roles and staff structures according to professional titles.

Specifically, the list of job roles issued by the central government is not comprehensive enough to cover all the functions and tasks of the public service unit (functions and tasks according to general regulations, excluding specific roles). Some circulars issued by specialized ministries do not include roles for leaders, managers at public service units under local authorities.

The People’s Committee of Ho Chi Minh City cites the circular issued by the Ministry of Construction, which does not define job roles and professional titles related to civil engineering even though it is a necessary role for public service units in the construction sector. The circular issued by the Ministry of Culture, Sports and Tourism does not have job roles for the tourism sector.

Meanwhile, the Ministry of Planning and Investment, and the Office of the Government do not issue job role lists for public service units under planning, investment and office management…

Also, the majority of the circulars issued by ministries and departments define the applicable objects as agencies and units under their management. Therefore, other agencies and units whose functions and duties are related to this area are not among the applicable objects.

According to the People’s Committee of Ho Chi Minh City, under the principle of decentralization and delegation, many agencies and units are assigned special functions and tasks, some agencies and units due to mergers and organizational restructuring have many additional unique functions and duties that are assigned by the People’s Committee of Ho Chi Minh City.

For this reason, there are many civil servant and public employee positions at the local level that are not included in the current regulations or circulars provided by ministries and agencies, but are in fact necessary and in line with the functions, duties and status quo of the locality.

The People’s Committee believes that the description of job roles by the ministries and sectors is not entirely aligned with the actual work at the local level, some roles require standards that are too high, specifically, in terms of political theory.

Implementing the general policy of streamlining staff positions and personnel, the current job roles of agencies and units are not yet linked to staff positions and personnel.

The staff positions and personnel currently allocated do not fully meet the needs of agencies and units in the context of increasingly complicated state management and public service provision.

Requesting to create specific job roles

Based on the above, the People’s Committee of Ho Chi Minh City requests the Ministry of Home Affairs to allow localities to create specific job roles that are not included in central government regulations, in line with the functions and duties of agencies and units. At the same time, ensuring the principle of alignment with the functions, duties, powers, organizational structure of agencies and units according to Government regulations.

However, the People’s Committee affirms that the creation of job roles, defining competency requirements for specific job roles will be based on assigned functions and duties, and professional title standards of specialized departments.

The People’s Committee of Ho Chi Minh City asserts that the guidance on the structure of public servants according to professional titles from the Ministry of Home Affairs is not specific, but general according to Decree 106/2020 of the Government.

Ho Chi Minh City requests the Ministry of Home Affairs to issue unified general guidance on the structure of public servants according to the professional title classification in the Law on Public Servants and implementing guidelines, as a basis for uniform implementation nationwide.
