Illegal Land Occupation Demands Compensation

On May 1, a source informed Báo Người Lao Động reporters that Quy Nhon Roadway Repair and Management Joint Stock Company (abbreviated as Quy Nhon Roadway Company, headquartered in Quy Nhon City) had just sent a document to relevant functional agencies in Binh Dinh Province regarding the parking lot at Lot A3, with an area of approximately 2.2 hectares, on Dien Bien Phu Street, Nhon Binh Ward, Quy Nhon City.

According to Quy Nhon Roadway Company, based on the approval and guidance of the Binh Dinh Provincial People’s Committee and the Quy Nhon City People’s Committee, the company began leveling and managing Lot A3 in 2019. Now, the province and Quy Nhon City are organizing a public auction without any recognition or preferential treatment for the company, which is considered unreasonable and unfair.

Therefore, Quy Nhon Roadway Company has proposed that since the government has obtained a clean land lot for auction, it should negotiate to reimburse the company for the costs and efforts it has invested in Lot A3 at the current market price.

In addition, Quy Nhon Roadway Company claims that over the past years, it has leveled and secured Lot A3 for the government. During this period, the company has been operating a parking service, but it is only temporary and its main purpose is to protect the land. Recently, the company has repeatedly submitted requests to competent authorities to consider land allocation, but no decision has been made regarding land use rights or land lease.

It is worth noting that in the above document, Quy Nhon Roadway Company also states: “Due to false and distorted public opinion in the media, functional agencies are proceeding with the collection of land use tax, which is unacceptable. Therefore, the company disagrees with the decision to collect land use tax arrears.

Resolutely Collecting Taxes as Prescribed

Regarding the above incident, Báo Người Lao Động has published a series of articles reporting on Quy Nhon Roadway Company’s illegal occupation of Lot A3 for an unauthorized parking lot.

Specifically, this company illegally leveled the land and put Lot A3 into use as a parking service for over 4 years without obtaining a license or land allocation from the competent authority. After Báo Người Lao Động reported on the matter, the Binh Dinh Provincial Department of Natural Resources and Environment issued a document requesting the Quy Nhon City People’s Committee to order Quy Nhon Roadway Company to dismantle and remove all structures and assets on the land so that the government could auction the land use rights for Lot A3.

Furthermore, the Chairman of the Binh Dinh Provincial People’s Committee also issued a document assigning the provincial Tax Department to take the lead, in coordination with the Quy Nhon City People’s Committee and other relevant functional agencies, to review and collect financial obligations related to the use of Lot A3 in accordance with regulations; and to issue a decision rejecting the Quy Nhon City People’s Committee’s proposal that the winning bidder of the project be required to reimburse Quy Nhon Roadway Company for the land leveling costs of nearly 5.6 billion VND.

However, not only did the company fail to comply, but it also issued a document with a number of objections to the decisions and directives of the Chairman of the Binh Dinh Provincial People’s Committee.

Lot A3, which Quy Nhon Roadway Company has been using “free of charge” for the past 4 years, has an area of 2.2 hectares and is located in a prime location on Dien Bien Phu Street, measuring approximately 110 meters wide and 200 meters long

Specifically, Quy Nhon Roadway Company argues that “the government assigned the project to the company,” but in reality, Lot A3 has not yet been licensed or allocated to any company for project implementation by the competent authority.

Regarding this incident, a leader of the Quy Nhon City Tax Office confirmed that the Binh Dinh Provincial People’s Committee’s document instructing functional agencies to collect financial obligations related to the use of Lot A3 is in accordance with regulations. Therefore, Quy Nhon Roadway Company’s request not to collect land use tax arrears has no basis.

“We are determined to collect land rent from this company. The financial obligations related to land will be calculated from the time the company began using Lot A3 until now,” said the leader of the Quy Nhon City Tax Office.
