“No Bailouts for Floundering BOT Projects: Holding Businesses Accountable”

Vice Prime Minister Tran Hong Ha has instructed the Ministry of Transport to conduct a comprehensive review and evaluation of all BOT traffic projects. He emphasized that there should be no proposals to address projects that encounter issues due to subjective reasons on the part of businesses or investors.

The Government Office issued Notification No. 190/TB-VPCP on May 3, concluding Deputy Prime Minister Tran Hong Ha’s directions on addressing challenges and obstacles in several transport infrastructure investment projects under the build-operate-transfer (BOT) format.

Accordingly, the Deputy Prime Minister has instructed the Ministry of Transport (MoT) to comprehensively review and assess all BOT projects, encompassing those under the ministry’s jurisdiction and those managed by local authorities. This review should meticulously scrutinize subjective and objective factors, policy changes implemented by the state, and the responsibilities of relevant agencies.

Notably, the Deputy Prime Minister emphasized refraining from proposing solutions for projects facing challenges due to enterprises’ and investors’ subjective reasons. These businesses and investors must assume full responsibility as per the signed contracts.

The Ministries of Finance, Planning and Investment, Justice, the Government Inspectorate, and the State Bank of Vietnam are tasked with closely coordinating with the MoT during the process of refining the dossiers. They are also expected to provide timely feedback when the MoT seeks their opinions.

The Deputy Prime Minister urged the MoT to promptly implement the aforementioned directions, refine the dossiers, proactively seek input from relevant ministries and agencies, as well as Party and National Assembly organs, and provide comprehensive explanations before submitting them to the Government’s Standing Committee, adhering to the Government’s working regulations.

Back in March, the MoT submitted a proposal to the Government, offering solutions to address challenges in eight transport infrastructure investment projects under the BOT format.

According to the MoT, the current challenges predominantly revolve around projects implemented before 2015. These projects have been completed and put into operation but have encountered issues with toll collection. Some have faced opposition from local residents regarding toll station locations, while others have experienced actual revenue significantly lower than the financial plan stipulated in the contracts…

The MoT proposed three groups of solutions for these eight BOT projects:

Group 1: Amend contracts and provide additional budgetary support for two projects experiencing irreversible revenue declines, requiring a total allocation of VND 1,557 billion.

Group 2: Adjust the government’s support mechanism for the BOT project of constructing a tunnel through Deo Ca Pass. The MoT suggested allocating approximately VND 2,280 billion from toll revenue on the Ho Chi Minh Road section between La Son and Tuy Loan to support this project. The expected toll collection period for repayment is about 28 years and 4 months. The La Son-Tuy Loan Expressway will be studied for a toll collection scheme to contribute to the state budget.

Group 3: Propose allocating more than VND 6,810 billion to terminate contracts ahead of schedule (covering five projects)
