Hanoi Authorities Order the Demolition of An Lac Wood Company’s Illegal Structures in the Thach That – Quoc Oai Industrial Park

On June 27, a competent official from the People’s Committee of Thach That District, Hanoi, confirmed to Báo Công Thương reporters that the People’s Committee had just issued a notice ordering the demolition of an illegal structure at plot CN3 in the Thach That – Quoc Oai Industrial Park, owned by An Lac Wood Company Limited.

“The notice was issued by the People’s Committee on June 21, 2024. The reason for ordering the demolition is that more than 90 days have passed since the administrative violation decision was issued, but An Lac Wood Company has not presented a construction permit,” the official said.

According to the official, An Lac Wood Company Limited must take measures to demolish the illegal structure within a maximum of 15 days from the date of the notice. If the company fails to do so, coercive measures will be taken as decided by law.

Previously, on March 13, 2024, the People’s Committee of Thach That District issued a decision to administratively sanction An Lac Wood Company in the amount of 130 million VND for violations in the construction field.

Specifically, An Lac Wood Company organized the construction of a project without a construction permit, while regulations require a construction permit for projects that must have an investment construction feasibility study report or an economic-technical report.

In addition to the administrative fine, the People’s Committee required An Lac Wood Company to remedy the violation within 90 days. “An Lac Wood Company must complete the dossier requesting the competent authority to grant a construction permit. If the company fails to present a construction permit within the specified time, it will be subject to forced demolition of the illegal structure,” the People’s Committee of Thach That District stated.

According to the Management Board of Industrial Parks and Export Processing Zones of Hanoi, An Lac Wood Company’s factory had erected a structural frame and was in the process of roofing without building perimeter walls. Additionally, there were other structures within the green space area of the industrial park, including a warehouse and an auxiliary building.

The Management Board emphasized that An Lac Wood Company’s construction of structures without obtaining a construction permit from the competent authority violated the basic construction law and the detailed planning approved by the authorized agency.

They requested that An Lac Wood Company immediately stop the construction, comply with the detailed planning of the industrial park and current regulations, and demolish the warehouse and auxiliary building to return the green space area of the industrial park.

At the same time, they proposed that the Ha Tay Development and Investment Joint Stock Company supervise and urge An Lac Wood Company to demolish the structures within the green space area and plant trees in the industrial park according to the approved detailed planning.

In mid-April 2024, the People’s Committee of Thach That District decided to fine An Lac Wood Company an additional 40 million VND for violations of fire prevention and control regulations.

Specifically, An Lac Wood Company was found to have “constructed a project subject to fire protection and control design review without obtaining a certificate or design review document as stipulated in Point a, Clause 3, Article 38 of Decree No. 144/2021/ND-CP dated December 31, 2021, of the Government.”

In addition to the monetary fine, the People’s Committee of Thach That District also forced An Lac Wood Company to remedy the violation by obtaining a fire protection and control design review.

Subsequently, the Hanoi People’s Committee, the Hanoi Department of Construction, the People’s Committee of Thach That District, the People’s Committee of Phung Xa Commune, and other relevant agencies of Thach That District issued numerous documents requesting strengthened inspection, prevention, and handling of An Lac Wood Company’s violations.

However, all efforts and directives from the Thach That District authorities and the Management Board of Industrial Parks seemed to be ineffective with An Lac Wood Company.

An Lac Wood Company is a well-known enterprise in Thach That District. In an interview with Báo Công Thương on April 8, 2024, Ms. Phan Thi Dung, Director of the Company, shared some objective difficulties that compelled the company to commit the violations.

Ms. Dung stated that they had purchased the land from Ha Tay Development and Investment Joint Stock Company in 2018 but had not yet obtained the land-use right certificate, which prevented them from acquiring a construction permit.

“Our company has applied for a construction permit, but because we don’t have the red book (land-use right certificate), we haven’t been approved. It’s been six years since 2018, and I don’t know the reason. Now, we can only wait,” Ms. Dung shared.
