Cases for re-granting granted Certificates:
1. Land users who wish to change their Certificates granted before August 1st, 2024, to Land Use Right Certificates and ownership of assets attached to the land.
2. Certificates that are stained, blurred, torn, or damaged.
3. Certificates granted collectively for multiple land plots, now requesting separate Certificates for each plot according to the land user’s needs, and cases of granting Land Use Right Certificates and ownership of assets attached to the land as prescribed.
4. The land use purpose stated on the granted Certificate according to land law at the time of issuance differs from the land use purpose according to land classification stipulated in Article 9 of the Land Law and detailed regulations in the Government’s decrees.
5. The location of the land plot on the granted Certificate is inaccurate compared to the actual location of the land at the time of Certificate issuance.
6. The land use right and ownership of assets attached to the land are common property of the husband and wife, but the granted Certificate only bears the name of the husband or wife. Now, a request has been made to re-grant the Land Use Right Certificate and ownership of assets attached to the land to include both the husband’s and wife’s names.
7. The granted Certificate bears the name of the household. Now, the household members with common land use rights request a re-grant of the Land Use Right Certificate and ownership of assets attached to the land to include the names of all members with common land use rights within the household.
8. Change of address of the land plot with a granted Certificate.
9. Changes in the dimensions, area, and plot number of the land due to land surveying and mapping or land plot extraction, provided that the land boundary remains unchanged.
File submission for the procedure of re-granting granted Certificates:
+ A registered land use change application, Form No. 11/ĐK, issued together with this Decree, and the granted Certificate.
In the case mentioned above (7), the registered application for land use change, Form No. 11/ĐK, issued together with this Decree, must include the information of the household members with common land use rights.
+ An extract of the land map for the case of land plot extraction mentioned in (9) above.
Procedure for re-granting granted Certificates:
+ Land users and owners of assets attached to the land shall submit the prescribed dossier to the dossier receiving agency: One-Door Division according to the regulations of the People’s Committee at the provincial level on the implementation of dossier reception and result delivery for administrative procedures at the provincial, district, and commune levels; Land Registration Office; or Branch of the Land Registration Office.
+ The Certificate-granting agency shall receive the dossier and schedule an appointment to return the results to the land user and owner of assets attached to the land.
In case the dossier-receiving agency is the One-Door Division according to the regulations of the Provincial People’s Committee, the dossier shall be transferred to the Land Registration Office.
