The Magic of Words: Crafting a Captivating Headline “HCMC People’s Committee Directives on the Implementation of the 2024 Land Law”

The Ho Chi Minh City People's Committee has issued new directives regarding the designated agency for receiving and processing applications related to land registration and immovable assets affixed to land, as per the Land Law 2024 regulations.

This directive is addressed to the Department of Natural Resources and Environment; People’s Committees of districts, counties, and Thu Duc City (district-level People’s Committees); and the City Land Registration Office.

The purpose of this directive is to ensure the timely implementation of the provisions of the 2024 Land Law, as well as related decrees, including Decree 101/2024 on land surveys, registration, and certification of land use rights and ownership of assets attached to land, and the establishment of a land information system; and Decree 102/2024, which details and guides the implementation of the 2024 Land Law.

To avoid disruptions in the process of receiving and processing applications for land and property-related procedures, the following instructions are provided:

Ho Chi Minh City People’s Committee has directed the implementation of the 2024 Land Law

The People’s Committee of Ho Chi Minh City provides the following instructions:

For procedures with changes in authority and procedure, the Department of Reception and Result Return at the district level shall receive the dossiers of domestic individuals, overseas Vietnamese who are Vietnamese citizens, and the community for the following four procedures:

  1. Registration and first-time certification;
  2. Redetermination of residential land area for households and individuals who have been granted certificates;
  3. Rectification of errors in the first-time issued certificates;
  4. Revocation and cancellation of first-time issued certificates.

The district-level People’s Committees shall organize the reception, handling, and result return in a linked manner as prescribed; arrange personnel with appropriate expertise and qualifications to work at the Department of Reception and Result Return.

Regarding maintaining the status quo, the branches of the Land Registration Office shall receive the dossiers of households, individuals, and the community, including overseas Vietnamese who are allowed to own houses attached to land use rights in Vietnam, for procedures related to registration and certification due to changes, except for cases of transfer of land use rights or purchase of houses and construction works in real estate projects.

The Land Registration Office branches shall assign personnel to the Department of Reception and Result Return at the office of the district-level People’s Committee. For branches with separate headquarters, they shall organize the reception of dossiers and result return at their headquarters as prescribed.

The Department of Reception and Result Return of the Department of Natural Resources and Environment shall receive the dossiers of organizations that are using land for the procedures of registration and first-time certification; rectification, revocation, and cancellation of first-time issued certificates.

The Department of Reception and Result Return of the City Land Registration Office shall receive the following dossiers:

  1. Registration and first-time certification; rectification; revocation and cancellation of first-time issued certificates for overseas Vietnamese with Vietnamese origins.
  2. Registration and certification due to changes for land-using organizations and overseas Vietnamese with Vietnamese origins.
  3. Registration and certification for individuals receiving the transfer of land use rights or purchasing houses and construction works in real estate projects.
  4. Rectification and revocation of certificates that have undergone procedures for registration of land and asset-related changes of land-using organizations and overseas Vietnamese with Vietnamese origins.

Report to the People’s Committee of Ho Chi Minh City any difficulties in implementing the 2024 Land Law

Regarding the procedures for land and asset-related registration, the People’s Committee of Ho Chi Minh City assigns the Department of Natural Resources and Environment, district-level People’s Committees, the City Land Registration Office, and its branches to proactively study and implement the 2024 Land Law, Decree 101, and Decree 102 when handling procedures related to land and assets attached to land.

The Department of Natural Resources and Environment is requested to urgently advise the People’s Committee of Ho Chi Minh City on specific decisions on the contents prescribed in Clause 6, Article 21 of Decree 101; provide guidance and synthesize the difficulties and problems of the district-level People’s Committees and the City Land Registration Office in implementing the 2024 Land Law.
