According to the People’s Committee of Lam Dong Province, the investor committed five violations during the investment and construction of the golf club building. Specifically, the investor constructed the building in deviation from the granted construction permit and constructed a building without a permit, with a total violation area of more than 23,700 m2. In addition, they constructed a building without a permit and deviated from the permit on an area of land that has not been approved for land use purpose conversion by competent authorities (over 4,631 m2).

Furthermore, the investor constructed the building without the detailed planning approval and the environmental impact assessment report approval by competent state agencies as stipulated in the Law on Environmental Protection 2020.

Violating constructions in the golf club building

Notably, the investor also carried out unauthorized and deviating constructions at a position belonging to Zone II of the Xuan Huong Lake scenic site without written permission from the Ministry of Culture, Sports and Tourism.

Serious Violation Handling

Regarding this issue, on August 13, the Lam Dong Provincial Department of Information and Communications organized a press briefing for August 2024. Ms. Tran Thi Vu Loan, Vice Chairman of Da Lat City People’s Committee, said that on August 8, the Chairman of Da Lat City People’s Committee worked directly with the investor, requesting the enterprise to voluntarily dismantle the violating constructions.

According to Ms. Loan, Da Lat City will continue to strictly handle the violations related to the construction order of the golf building project.

Also at the conference, Mr. Ngo Van Ninh, Chief of Office and representative of the Lam Dong Provincial People’s Committee, stated that the province would resolutely handle the violations in the investment and construction of the golf club building in accordance with current regulations.

As for the revocation and annulment of the document on including 29.5 hectares of land at Doi Cu Golf Course in the area of inner-city protective forest land, Mr. Ninh said that the previous decision to revoke and annul the document complied with the provisions of the law. This does not mean that the violations at the golf club building constructions of Hoang Gia Da Lat Joint Stock Company will not be handled.

“In the coming time, the People’s Committee of Lam Dong Province will continue to direct the departments, branches, and Da Lat City People’s Committee to resolutely handle the violations in the spirit of upholding the law. Besides, it is necessary to focus on handling and applying remedial measures and thoroughly dismantling the unauthorized and deviating constructions in accordance with the right spirit and viewpoint that violations in any field must be thoroughly and definitively handled in that field,” emphasized Mr. Ninh.

Previously, Ward 1 People’s Committee (Da Lat City) had established a plan to forcibly dismantle the above-mentioned violating constructions. The enforcement was expected to last for two months, costing 32 billion VND. However, on the morning of July 17, when the functional forces were about to enforce it, the enforcement was suspended due to a court decision.
