On August 15, the People’s Court of Ho Chi Minh City held a meeting to resolve a request to annul a decision made by the VIAC, as petitioned by M-TP Talent JSC (M-TP Talent, headquartered in District 7, Ho Chi Minh City). TAD Global Vietnam JSC (TAD Global) was the involved party.

According to the documents, Nguyen Thanh Tung (also known as Son Tung M-TP) is the Chairman of the Board of Directors and legal representative of M-TP Talent JSC. On March 31, 2022, TAD Global signed a contract for service provision and image usage rights with M-TP Talent, valued at over VND 25 billion, with a term of 12 months.

Per the contract, Nguyen Thanh Tung was to produce digital content and utilize it on the RACA virtual universe platform. TAD Global was to create a virtual land for artist Son Tung M-TP on the RACA platform, including virtual characters, avatars, and virtual items.

While TAD Global had made a full service payment, due to Son Tung M-TP being administratively sanctioned in May 2022 for his music video “There’s No One at All,” TAD Global was reluctant to proceed with the subsequent tasks, which included attending a filming performance, shooting, and posting on social media, with a total value of approximately VND 6.2 billion.

In June 2023, M-TP Talent declared its refusal to execute the contract, citing its expiration. TAD Global disagreed and filed a lawsuit against M-TP Talent at the VIAC. In April, the VIAC ruled in favor of TAD Global, ordering M-TP Talent to pay nearly VND 6 billion to TAD Global.

Discontent with the ruling, M-TP Talent requested the People’s Court of Ho Chi Minh City to annul the arbitral award. At the meeting on August 15, M-TP Talent asked the Council to annul the VIAC’s decision. TAD Global, on the other hand, presented various arguments to demonstrate that the VIAC’s ruling adhered to arbitral principles and requested the Court to reject M-TP Talent’s petition.

Nevertheless, the Council decided to annul the VIAC’s ruling, granting the request made by M-TP Talent.
