The Government Inspectorate has just issued a notice on the conclusion of the inspection of the People’s Committee of Gia Lai province’s responsibility in managing and using agricultural and forestry land, as well as sand, soil, and gravel exploitation and construction investment in the province.
The inspection period was from January 1, 2016, to December 31, 2020 (related issues before or after this period could also be considered).
One of the projects mentioned in the conclusion of the Government Inspectorate is the investment project for the construction of the Hoang Dieu Asean School.
According to the Government Inspectorate, the People’s Committee of Gia Lai province failed to rearrange public land for auction as per the Prime Minister’s Decision No. 09/2007/QD-TTg dated July 19, 2007. This has led to potential state budget losses in terms of land rent exemption and reduction for the investment project for the construction of the Hoang Dieu Asean School.
Therefore, the Government Inspectorate recommends that the People’s Committee of Gia Lai province direct the re-determination of land prices, revoke the decision on land rent exemption, collect land rent, and calculate late payment penalties (if any) to ensure full and proper collection. If there are any signs of criminal law violations during this process, the People’s Committee should transfer the case to competent authorities for handling in accordance with regulations. They should also instruct relevant units to inspect and consider handling in accordance with regulations, rectifying any violations. If criminal law violations or irreparable violations are discovered, the case should be transferred to competent authorities, and the results reported to the Government Inspectorate. The People’s Committee of Gia Lai province is responsible for their decisions in handling violations related to the investment project for the construction of the Hoang Dieu Asean School.
It is known that the investment project for the construction of the Hoang Dieu Asean School at 39 Han Mac Tu, Tra Ba Ward, Pleiku City is invested by the Asean Community Cultural and Educational Development Joint Stock Company.
The land lot for this project has an area of 24,744m2 and was once a public asset valued at VND 2.9 billion by the Provincial Finance Department in 2012. However, in 2013, the People’s Committee of Gia Lai province agreed to sell this asset directly to the Asean Community Cultural and Educational Development Joint Stock Company.
According to our information, the Asean Community Cultural and Educational Development Joint Stock Company (abbreviated as Asean Education Community Company) was established in November 2011 and is headquartered at 39 Han Mac Tu, Tra Ba Ward, Pleiku City.
As of January 4, 2019, the company reduced its charter capital from VND 82.5 billion to VND 12.4 billion. The shareholders included General Director Pham Thi Thuy with a stake of 41.12%, and other shareholders: Tran Kim Dung, Dao Tuan Ngoc, Khuc Van Mat, Nhu Van Hoan, Tran Thi Hong Thuy, and Vu Duong Thuy, whose ownership ratios were not disclosed.
From this time, Mr. Luong Van Anh (born in 1976) held the position of Chairman of the Board of Directors and General Director and was the legal representative of the enterprise.
On January 16, 2019, the company again increased its charter capital to VND 82 billion. At this time, Ms. Pham Thi Thuy owned only 6.2%, and the ownership ratios of other shareholders were not disclosed.
In January 2020, Mr. Truong Dinh Tu became the General Director, joining Chairman Luong Van Anh as the legal representative of the company.
In June 2020, the company increased its charter capital to VND 150 billion, with Ms. Pham Thi Thuy holding 3.4% and the ownership ratios of other shareholders not disclosed. Since March 2022, Ms. Nguyen Quynh Hanh has been the General Director of the company.
It is known that Mr. Luong Van Anh is also the representative of Dak Pru 3 Hydropower Joint Stock Company and GE Tay Nguyen Joint Stock Company.
Returning to the land lot at 39 Han Mac Tu, Tra Ba Ward, Pleiku City, in 2018, the Asean Education Community Company started constructing the Nguyen Khuyen Kindergarten, Elementary School, Middle School, and High School on this land lot.
According to our data, in October 2019, the Asean Education Community Company mortgaged all assets, including equipment attached to the constructions, and investment equipment serving the operation of Nguyen Khuyen School at Sacombank – Gia Lai Branch.
In September and October 2021, the Asean Education Community Company twice mortgaged the auxiliary works of Nguyen Khuyen Kindergarten and Nguyen Khuyen School at Sacombank – Gia Lai Branch.
