The Government Office has just announced the Conclusion of Deputy Prime Minister Tran Hong Ha at the online conference with localities on the issuance of supplements and updates to the plan to implement the Master Plan for Power Development in Vietnam for the period of 2021-2030, with a vision to 2050 (Power Development Plan VIII).

The conclusion includes directions from the Deputy Prime Minister regarding several projects related to inspection and investigation conclusions that have not been properly reviewed and addressed by local authorities and the Ministry of Industry and Trade.

The Deputy Prime Minister instructed the Ministry of Public Security to carefully scrutinize the list of 154 solar power projects referred by the Government Inspectorate, providing analysis, evaluation, and criteria for project classification based on identified violations.

For projects that do not involve criminal law violations or those with rectifiable infractions, the Ministry of Public Security is tasked with proposing solutions to prevent waste of state, business, and people’s assets, and reporting the results to the Prime Minister before August 30, 2024.

Additionally, the Deputy Prime Minister assigned the Ministry of Industry and Trade to collaborate with the Ministry of Public Security in scrutinizing the 154 solar power projects, categorizing those with legal entanglements and those with rectifiable legal issues in accordance with the conclusions of inspections, examinations, and investigations, while adhering to the nine criteria set forth.

Furthermore, the Deputy Prime Minister urged the provinces of Dak Lak, Ninh Thuan, and Ba Ria-Vung Tau to promptly review and supplement relevant information and documents for seven wind power projects, addressing violations mentioned by the Government Inspectorate, and aligning with the nine criteria established by the Ministry of Industry and Trade.

Regarding wind and hydropower projects, the Ministry of Industry and Trade is instructed to collaborate with the Government Inspectorate to conduct a thorough review.

In cases where projects are only named in the conclusion as being delayed due to objective factors, such as slow compensation processes, or where violations and infractions have been or are being rectified with documentation sent to the Ministry of Industry and Trade, the Ministry is responsible for compiling and reporting to the Prime Minister for consideration in accordance with legal regulations, preventing waste of business investment resources, and meeting local development requirements.

The Ministry of Industry and Trade is also tasked with coordinating with localities to review solar and wind power projects with energy storage systems, waste-to-energy, biomass, and other projects, proposing supplements and ensuring compliance with the allocated capacity for each locality, and maintaining feasibility.

Previously, the Conclusion of the Inspection on the Management of Investment and Construction of Power Projects under the Power Development Plan VII and its Adjustment, issued by the Government Inspectorate on December 25, 2023, clearly stated that the addition of 154 solar power projects with a total capacity of 13,837 MW to the Power Development Plan VII by the Ministry of Industry and Trade was “without legal basis or grounds.”

As a result, the Government Inspectorate transferred the case to the investigative agency to clarify the presence of signs of criminal offense of “irresponsibility causing serious consequences.”
