Authorities in Chi Linh City, Hai Duong Province, have recently arrested and prosecuted Mr. Nguyen Trung Vuong for the alleged offense of Production and Trading of Counterfeit Food Products.

Investigators charged Mr. Vuong with knowingly producing and trading substandard food products. The products were found to have significantly lower quality than what was declared and labeled, with only about 70% of the stated quality standards being met. Furthermore, these products were deemed to have no functional value, as per the declared specifications, and posed potential health risks to consumers. Despite this knowledge, Mr. Vuong allegedly continued these operations, driven by profit motives.

This case bears resemblance to a previous incident that occurred two years ago at the Holland Milk Joint Stock Company, registered on Tran Cung Street, Bac Tu Liem District, Hanoi. The Environmental Crime Prevention Police Department of the Ministry of Public Security had initiated legal proceedings against the company for Production and Trading of Counterfeit Food Products.

In that instance, the company’s milk powder products were alleged to have deviated from the declared standards in terms of ingredient composition. These products were deemed ineffective and potentially harmful to consumers’ health, as per the authorities’ accusations.

Holland Milk’s products were sold through various channels, mainly through trade unions, product introduction workshops, and social media.

Most of the products were manufactured at the company’s Holland Milk Factory in Cong Hoa Ward, Chi Linh City. However, the company failed to maintain product samples, establish an independent laboratory, or conduct periodic product testing.

Out of 67 batches of finished products, equivalent to 33 types of products from 8 companies manufactured at the Holland Milk Factory, investigators found that 66 batches fell significantly short of quality standards, with only about 70% of the declared quality being achieved. This amounted to 29,400 cans, valued at VND 4.1 billion.

These substandard products were sold through multiple channels, primarily through trade unions, product introduction workshops, and social media platforms.

Mr. Nguyen Trung Vuong is accused of directly overseeing and instructing employees throughout the entire process, from production to product distribution. This included purchasing raw materials, developing procedures, accepting orders, selecting products, determining quantities and prices, and arranging delivery times.

He is also alleged to have devised the formula, modified the composition, and adjusted the proportions of ingredients contrary to the declared specifications, directing his staff to carry out these changes.

The Dutch Lady is a brand owned by FrieslandCampina Vietnam

On August 30, in a conversation with Tuoi Tre Online, a representative of the Dutch Lady brand, operated by FrieslandCampina Vietnam (a subsidiary of Royal FrieslandCampina of the Netherlands), addressed the concerns and misunderstandings of consumers regarding the arrest of the director of Holland Milk Joint Stock Company on charges of producing and trading counterfeit goods.

The representative clarified that there is a distinct difference between the two companies, which has led to confusion due to their similar names. While both companies share the word “Holland” in their names, they are entirely separate entities. Importantly, the Dutch Lady brand specializes in liquid milk, whereas the counterfeit products produced and traded by Holland Milk Joint Stock Company were in the form of milk powder.

FrieslandCampina Vietnam emphasizes the distinction between their Dutch Lady brand and the Holland Milk Joint Stock Company.

FrieslandCampina Vietnam had previously issued a clarification two years ago to the media regarding this confusion. They emphasized that the Dutch Lady brand, owned by FrieslandCampina Vietnam, is entirely unrelated to the Holland Milk Joint Stock Company, which operates independently and has no association with the Royal FrieslandCampina Group or the Dutch Lady brand.

FrieslandCampina Vietnam, a subsidiary of Royal FrieslandCampina of the Netherlands, specializes in the production and distribution of liquid milk products under the Dutch Lady brand. In Vietnam, the company offers a range of products, including liquid milk, Dutch Lady-branded formula products, Friso formula milk, Yomost drinking yogurt, Fristi nutritional drinks, and condensed and evaporated milk under the Hoan Hao, Truong Sinh, and other brand names for business customers.

“FrieslandCampina fully supports the authorities in taking strict action against Holland Milk Joint Stock Company for their violation of the law, prioritizing the interests and health of consumers,” the representative of FrieslandCampina Vietnam stated two years ago.
