A number of citizens from Phuc Thinh and Tien Phong villages, Giai Phien commune, Yen Bai city
petitioned for inadequate support, lack of fairness, inaccuracy, and low compensation when the state reclaimed land for the road project connecting National Highway 37, National Highway 32C, and Noi Bai – Lao Cai Expressway.
The Chairman of the Provincial People’s Committee assigned the Board of Investment Construction Management of Traffic Works of the province to coordinate with the People’s Committee of Yen Bai city and related units to inspect and evaluate the current situation, detailing the extent of the impact and comparing it with legal regulations and practical circumstances. They will then handle and resolve the citizens’ requests according to legal procedures, ensuring objectivity, fairness, and accuracy. Additionally, they will communicate, persuade, and explain the situation to gain the citizens’ understanding and agreement.
Four citizens from Nuoc Mat village, Au Lau commune, Yen Bai city
pointed out that the land reclamation for the Au Lau Industrial Park project (Resettlement category) was inappropriate and that their households’ land was not within the boundaries of the industrial park. They requested that their land be allowed to change its purpose. Moreover, while the People’s Committee of Yen Bai city is considering and resolving the issue according to the complaint procedure, they are still issuing decisions to enforce the land retrieval from these households, which is inappropriate. The deadline for resolving the complaint has passed, and the households have not received a response.
After reviewing the case, the Chairman of the Provincial People’s Committee concluded that the citizens’ complaint has been received by the Chairman of the People’s Committee of Yen Bai city and is being inspected and verified according to Decision No. 2443 dated June 10, 2024.
To avoid complex and prolonged complaints, the People’s Committee of Yen Bai city is requested to carefully review the case, focus on resolving it, and promptly issue a decision on the citizens’ complaint according to legal procedures, ensuring timely resolution. The resolution outcome should be reported to the Chairman of the Provincial People’s Committee before September 5, 2024.
If the citizens disagree with the decision made by the Chairman of the People’s Committee of Yen Bai city, they have the right to file a second complaint with the Chairman of the Provincial People’s Committee or initiate legal action at the People’s Court of Yen Bai province.
Regarding the enforcement of land retrieval, the Chairman of the Provincial People’s Committee concluded that according to Point c, Clause 2, Article 12 of the Law on Complaints 2011, which stipulates the obligations of the complainant, the households must still implement and comply with the land retrieval decision made by the competent authority during the complaint resolution process. The households are requested to study and comply with this regulation.
Ms. Nguyen Thi Huan, house number 230, Group 7, Yen Ninh ward, Yen Bai city
requested the retrieval and cancellation of land use certificates incorrectly issued to Mr. Cao Van Vo, which overlap with her family’s land area of 3,219 square meters.
The Chairman of the Provincial People’s Committee assigned the People’s Committee of Yen Bai city to carefully review the case, based on the verification results, the directions of the Provincial Party Committee, legal regulations, the handling and resolution of competent authorities, and the actual situation. They will then consider and resolve Ms. Huan’s request, ensuring compliance with legal regulations and protecting the legitimate rights and interests of citizens.
Citizen Pham Thi Tuyen, Tien Phu village, Van Phu ward, Yen Bai city
requested 100% compensation for the value of her house and land allocation for her daughter’s resettlement when the state retrieved their land for the construction of the Yen Bai city flood bypass project (now Au Co road, Yen Bai city).
This issue has received attention and direction from the Provincial People’s Committee for resolution according to regulations. The People’s Committee of Yen Bai city has provided many documents to resolve and respond to the citizen’s requests within their authority. However, the citizen disagrees with the resolution of the People’s Committee of Yen Bai city and continues to send petitions to the Provincial People’s Committee.
Previously, on April 8, 2024, the Provincial Inspectorate issued Document No. 277 in response to Ms. Pham Thi Tuyen’s request, as regulated.
The Chairman of the Provincial People’s Committee suggested that Ms. Pham Thi Tuyen study and implement the resolution. If there are any further questions or concerns, she can contact the People’s Committee of Yen Bai city and the Provincial Inspectorate for explanations and responses.
Also in Van Phu ward, Ms. Nguyen Thi Yen, Tien Phu village
requested a review of Decision No. 343 dated February 22, 2017, of the People’s Committee of Yen Bai city regarding the retrieval of her family’s land.
Ms. Nguyen Thi Yen argued that the People’s Committee of Yen Bai city previously retrieved her family’s land for the Van Phu bridge node project but now plans to allocate it for resettlement, which she believes is inappropriate. She requested that the above land area be returned to her family for use.
On this matter, on April 10, 2024, the People’s Committee of Yen Bai city issued Document No. 929 in response to Ms. Nguyen Thi Yen’s request. If the citizen disagrees with the content of the response and has grounds to believe that the city’s resolution and response are incorrect, she has the right to file a complaint or initiate legal action to be considered and resolved according to regulations.
Additionally, the Chairman of the Provincial People’s Committee assigned departments, sectors, and the People’s Committee of Yen Bai city to review, study, and respond to some requests related to compensation for the area of agricultural land currently planted with tea trees, the non-receipt of honorary awards and rewards as regulated, etc.
