On August 28th, the Ninh Binh Provincial Party Committee’s Internal Affairs Commission sent a document to the Chairman of the Tam Diep City People’s Committee, requesting an inspection and resolution of Mr. Ha Tuan Cuong’s petition (a resident of Ninh Binh city). The response was addressed to the citizen and reported back to the Provincial Party Committee’s Internal Affairs Commission before October 10th, 2024.
According to Mr. Ha Tuan Cuong’s petition, before 2017, his family worked in mining for Construction Company Limited Unified (Unified Company) in the Three Crest Hill area of the Round Farm in Quang Son commune, Tam Diep city, Ninh Binh. When the mining project license expired in 2017, the Unified Company moved out, but the state did not revoke the land area where the company had built offices and workshops.
To prevent land degradation, Mr. Cuong’s family purchased an additional 120,000 square meters of land from households in the Dong Giao Farm (also in Quang Son commune, Tam Diep city). This land was used for their residence, agricultural production, and animal husbandry.
“From 2019 to 2023, local authorities did not offer any support or hindrance to my activities. However, at the end of 2023, the People’s Committee of Tam Diep City issued an enforcement decision, requiring my family to remedy the situation by self-demolishing the structures on the land or face forced demolition,” said Mr. Cuong.
Mr. Cuong shared that his family complied and signed a contract with a demolition unit, completing 80% of the work. However, the process was delayed due to the National Mourning and continuous rain.
“However, on July 31st, 2024, Mr. Tong Duc Thuan, Vice Chairman of the People’s Committee of Tam Diep City, directed about 150 people with machinery to my land to carry out the enforcement. As of now, my family’s assets have been completely destroyed, including buildings, flower pots, ornamental and fruit trees, and livestock,” Mr. Cuong stated in his petition. He added that the trees, fruit trees, ornamental trees, fish ponds, and livestock were not included in the enforcement notice and were not subject to enforcement.
Mr. Cuong provided a statement showing that he had spent over 200 million VND on purchasing plants and livestock.
Previously, the Chairman of the People’s Committee of Tam Diep City had issued a decision and notification regarding the organization of enforcement to compel Mr. Ha Tuan Cuong in Quang Son commune, Tam Diep city, to implement remedial measures for 16 structures. The enforcement was scheduled for July 25th, 2024, from 7:30 AM to 5:00 PM. However, due to the National Mourning, the People’s Committee of Tam Diep City postponed the enforcement to July 31st, 2024, starting at 7:30 AM.
The People’s Committee of Tam Diep City estimated that the enforcement would cost approximately over 350 million VND.
