The Ministry of Science and Technology has proposed regulations on the application of technology in quality management and product traceability in the draft Law on Amending and Supplementing a Number of Articles of the Law on Product and Goods Quality, which is currently under consultation.

FACILITATING ENTERPRISES’ PARTICIPATION IN GLOBAL E-COMMERCE

In the draft proposal, the Ministry of Science and Technology clearly states that technology application is one of the measures to manage product quality, including the use of barcodes and electronic labels.

Barcodes are an effective tool that is commonly used in management and by all parties in the supply chain, such as manufacturers, retailers, transport services, regulatory agencies, and consumers.

The regulation on electronic labeling is a way to support and complement the traditional physical labeling methods (such as sticking, printing, attaching, casting, engraving, etc.) for manufacturers to convey information and mandatory content as required. Electronic labeling allows some mandatory content to be displayed electronically and shown on a screen rather than a physical label.

According to the Ministry of Science and Technology, barcodes are a fundamental element in linking information about the conditions for ensuring product quality (conformity declaration, conformity certification, and product conformity) in quality management.

It serves as a tool for manufacturers to monitor product quality, trace, and determine the origin and causes of product-related incidents; for consumers to inquire and search for information about product quality; and for government agencies to manage the production and circulation of products.

Notably, barcodes facilitate international trade and integration by making it easier for enterprises to participate in global e-commerce. They also help in product traceability, providing product data to trading partners, integrating with customs and tax data for declaration, clearance, and tax calculation, and supporting control over import and export flows.

Currently, countries are enhancing inspections of product origins through the application of technology, including barcodes.

To prevent origin fraud and transshipment of counterfeit goods to third countries, some nations have implemented measures to combat counterfeiting and origin fraud, safeguarding the reputation of their products.

Like many other countries, Vietnam’s customs and competent authorities proactively detect, prevent, and handle acts of fraud, fake labeling, intellectual property infringement, and illegal transshipment.

Verifying the use of foreign codes, strengthening inspections of labeled goods in circulation, and timely detecting violations in Vietnam will enhance the competitiveness of Vietnamese products in the international market. It will also transparentize the origins of products in the market, increasing their credibility with customers.

VERIFYING PRODUCT ORIGIN THROUGH TECHNOLOGY APPLICATION

The Ministry of Science and Technology believes that, in the current context, digital transformation will bring added value to enterprises, helping them create new value by providing customers with new experiences. It also facilitates the export process, enhancing their reputation and brand in the domestic and foreign markets.

The identification, coding, and machine-readable information collection are prerequisites for digitizing and exchanging electronic data between units in the supply chain and the foundation for electronic traceability solutions.

At the same time, the National Portal for Product and Goods Traceability can support the display/reference/forwarding to geographical indication data, online map data, and electronic atlas data when these data sources are ready.

Product traceability systems will be allowed to use geographical indication data, online map data, and electronic atlas data when the above synchronization is available.

Applying barcodes on technology platforms such as Blockchain, IoT, AI, and other new technologies will create a digital ecosystem and big data, aligning with global development trends. It is a fundamental element that links information about the conditions for ensuring product quality (conformity declaration, conformity certification, and product conformity);

It also serves as a tool for manufacturers to monitor product quality, trace and determine the origin and causes of product-related incidents, and enables consumers to inquire and search for information about product quality.

Therefore, in the draft law, the Ministry of Science and Technology proposes to supplement regulations on the application of technology in product quality management. This proposal aligns with Directive No. 38-CT/TW dated July 30, 2024, of the Secretariat on promoting national standards, measurement, and quality until 2030 and beyond.

Specifically, the state has a policy to support and promote the application of technology in monitoring and managing product quality. It encourages organizations and individuals to invest in and build technical infrastructure and develop human resources to apply technology in product quality supervision and management.

The Ministry of Science and Technology assists the Government in unifying the state management of technology application in product quality supervision and management, including barcodes, product traceability, electronic labels, and technologies based on barcodes.

The industry-managing ministries and branches and the People’s Committees of provinces and centrally-run cities coordinate with the Ministry of Science and Technology to deploy technology application in product quality supervision and management within their assigned scope and field.
