Specifically, the Deputy Prime Minister approved in principle and agreed to the investor of the project being Geleximco Hung Phu Joint Stock Company.
The project is located in Nam Hung, Tien Hai District, Thai Binh Province, with a total investment capital of VND 1,939,641 billion, of which the investor’s contribution capital is VND 300 billion.
The duration of the project is 50 years from the date of approval of the investment policy and the selection of the investor.
The Deputy Prime Minister assigned the Ministry of Planning and Investment to be responsible for the contents assigned to appraise the investment policy of the project and to manage the state over industrial parks in accordance with the Law on Investment and relevant legal documents.
The Ministries and branches are responsible for the contents of the appraisal of the project’s investment policy within the functions and tasks assigned according to the Law on Investment and relevant legal documents.
Ensuring the accuracy of the appraisal contents as prescribed
The People’s Committee of Thai Binh province is responsible for ensuring the accuracy of information, data, and appraisal contents as prescribed by law; responsible for the conformity of the project with the approved planning; managing and using the remaining area of the Hung Phu Industrial Park planning (5.92 ha) in accordance with the law on planning, the law on management of industrial parks, the law on land, and relevant legal documents; absorbing the opinions of the Ministries and branches.
At the same time, it shall inspect and supervise the allocation of land use quotas in accordance with the approved project implementation schedule; comply with the planning norms and the national plan for land use that has been allocated to Thai Binh province.
Ensure conditions, procedures, and land lease for land use purpose conversion, including rice land, to implement the project in accordance with the law; have a plan to supplement the land area or increase the efficiency of other rice land use to compensate for the converted rice land in accordance with the law; inspect and supervise the peeling and use of the surface layer of land in accordance with Clause 4, Article 14 of the Government’s Decree No. 94/2019/ND-CP dated December 13, 2019, detailing a number of articles of the Law on Cultivation on plant varieties and cultivation; comply with the regulations on compensation, support, and resettlement when the State recovers land.
Organize the construction and implementation of the plan for land recovery, compensation, site clearance, land use purpose conversion, and land lease to implement the project suitable to the approved documents on the scale of area, location, and progress of the project implementation; ensure no disputes or complaints about the right to use the project implementation site.
Direct relevant agencies and investors to comply with the provisions of law on irrigation, dykes, water resources, and natural disaster prevention; have a design plan to ensure no impact on dyke safety and the management and operation of the irrigation system and the cultivation capacity of people in the area.
In case there are assets of the State in the project implementation area, the People’s Committee of Thai Binh province shall arrange and handle the assets of the State in the project implementation area in accordance with the law on management and use of assets of the State and other relevant legal documents, ensuring no loss of State assets.
Land allocation and land lease for small and narrow land plots managed by the State (if any) must meet the criteria prescribed in Clause 1, Article 47 of the Government’s Decree No. 102/2024/ND-CP dated July 30, 2024, detailing a number of articles of the Land Law.
Implement commitments on arranging land funds for the construction of housing and service and utility works for workers working in Hung Phu Industrial Park according to the approved planning of Nam Phu urban area, Tien Hai district.
Ensuring the location and area of the project in line with the investment policy
The People’s Committee of Thai Binh province directs the Management Board of Economic Zones and Industrial Parks of Thai Binh province and relevant agencies to review and ensure that the project implementation area does not have tangible cultural heritage sites or affect intangible cultural heritage products in Thai Binh province; in accordance with the requirements for protection and promotion of the values of cultural heritage and the conditions prescribed by the law on cultural heritage.
Guide, inspect, and supervise investors to implement the detailed planning of Hung Phu Industrial Park construction that has been approved by the competent authority, complete the construction procedures in accordance with the law on construction; ensure the location and area of the project in line with the approved investment policy; the land use structure of the project and the environmental safety distance comply with the national technical regulations on construction planning and other relevant regulations; attract investment projects into the industrial park in accordance with the orientation of focusing on developing the manufacturing industries of the Red River Delta region as prescribed in Point b, Clause 1, Article 3 of the National Assembly’s Resolution No. 81/2023/QH15 dated January 09, 2023, on the national master plan for the 2021-2030 period, with a vision to 2050, the orientation of industrial park development prescribed in Point b, Item 3, Part V, Article 1 of the Prime Minister’s Decision No. 368/QD-TTg dated May 04, 2024, approving the planning of the Red River Delta region for the period of 2021-2030, with a vision to 2050, and the plan for the development of the system of industrial parks prescribed in Appendix II to the Prime Minister’s Decision No. 1735/QD-TTg dated December 29, 2023, approving the planning of Thai Binh province for the period of 2021-2030, with a vision to 2050.
Require investors: (i) during the implementation process, if there are works deeper than -100m or minerals with higher value than common construction minerals are discovered, they must report to the competent state agency in accordance with the law on minerals; (ii) coordinate in compensation, support, resettlement, and investment in the construction of worker housing, service and public utility works for workers working in the industrial park.
Inspect and determine that the investor meets the conditions for the State to lease land and change the land use purpose at the time of land lease; closely monitor the progress of the project implementation, the use of owner equity capital as committed to implement the project; meet the conditions of the investor as prescribed by the law on real estate business when implementing the business of industrial infrastructure and the investor’s commitment to ensure the conditions for industrial infrastructure investment in accordance with Decree No. 35/2022/ND-CP.
Investors are only allowed to implement the project when they meet the conditions
Geleximco Hung Phu Joint Stock Company (investor) is responsible before the law for the legality, accuracy, and truthfulness of the project dossier and documents sent to the competent state agency; comply with the provisions of law in implementing the project according to this Decision; bear all risks, costs, and full responsibility according to the provisions of Articles 47 and 48 of the Law on Investment in case of violation of the provisions of law on investment and land; absorb the opinions of the Ministries, branches, and the People’s Committee of Thai Binh province.
Use owner equity capital as committed to implement the project and comply with the law on land and other relevant legal documents; meet all conditions prescribed by the law on real estate business when implementing the business of industrial infrastructure; are only allowed to implement the project when meeting the conditions prescribed by law, including being permitted by the competent authority to convert the land use purpose of rice land and having to pay an amount of money to protect and develop rice land in accordance with the law on land.
Comply with the provisions of Article 57 of the Law on Cultivation and Article 14 of Decree No. 94/2019/ND-CP; carry out procedures for environmental protection in accordance with the provisions of the law on environmental protection and relevant guiding documents; make a deposit or have a bank guarantee for the obligation to make a deposit to ensure the implementation of the project in accordance with the law on investment…
