
On September 13, the Supreme People’s Procuracy of Vietnam issued an indictment on charges of “Violation of regulations on bidding, causing serious consequences”, “Giving and Taking Bribes”, and “Abuse of Power in Performance of Official Duties” at the Bac Ninh Department of Health and AIC Joint Stock Company.
The indictment proposes the prosecution of four individuals for “Taking Bribes”: Nguyen Nhan Chien, former Secretary of the Provincial Party Committee of Bac Ninh; Nguyen Tu Quynh, former Chairman of the Provincial People’s Committee of Bac Ninh; Nguyen Hanh Chung, former Provincial Committee member and former Vice Chairman of the Provincial People’s Council of Bac Ninh; and Tran Van Tuynh, former director of the Project Management Board for Health Construction in Bac Ninh Province.
Nguyen Tien Nhuong, former vice chairman of the Bac Ninh People’s Committee, was charged with “Abuse of Power in Performance of Official Duties”.
Nguyen Thi Thanh Nhan, chairman of AIC Company (currently at large), was accused of “Giving Bribes”. Previously, Nhan had been tried in absentia in three other cases in Dong Nai, Quang Ninh, and Ho Chi Minh City, with a total sentence of 30 years in prison.
In this case, seven individuals were indicted for “Violation of regulations on bidding, causing serious consequences”. They are: Nguyen Hong Son, deputy director of AIC Company (at large); La Tuan Hung, general director of Song Hong Company; Nguyen Dang An, former head of the Planning Department of the Management Board; Nguyen Kim Huan, former deputy head of the Planning Department of the Management Board; Nguyen Viet Toan and Nguyen Dang Linh, both former employees of AIC Company; and Dang Xuan Minh, chairman of BTC VALCE Valuation Company.
According to the conclusion, in 2013, Mr. Dang Tien Phong, chairman of Song Hong Company (deceased in 2021), contacted Tran Van Tuynh to discuss the matter of him being in charge of requesting additional capital from the Prime Minister for the health sector in Bac Ninh province.
In return, Mr. Tuynh and the Bac Ninh provincial government had to help Song Hong Company win six medical equipment packages at hospitals in Tien Du, Que Vo, Yen Phong, Gia Binh, Luong Tai, and Thuan Thanh districts.
Mr. Tuynh agreed, but later, Ms. Nhan from AIC Company also contacted him with a similar request. Knowing that Ms. Nhan had connections with leaders in Bac Ninh province and the Central Government, Mr. Tuynh reported this to Mr. Son.
The two sides then agreed that “to avoid collision”, Song Hong Company would implement three packages at hospitals in Yen Phong, Tien Du, and Que Vo districts (northern districts of Duong River), while AIC Company would implement three packages at Gia Binh, Thuan Thanh, and Luong Tai districts (southern districts of Duong River).
The investigating agency accused the accused of violating regulations, using “green soldiers” in bidding, raising prices… Up to now, all six packages have been handed over and caused a loss of 48 billion VND to the state budget.
During this process, the leaders of Song Hong Company, Mr. Dang Tien Phong, and the accused Le Tuan Hung, bribed Tran Van Tuynh with 6 billion VND. Mr. Tuynh then gave 1 billion VND each to the former Secretary Nguyen Nhan Chien and the former Chairman Nguyen Tu Quynh; and gave gifts to the former vice chairman Nguyen Tien Nhuong several times, totaling 300 million VND.
In addition, the accused Nguyen Thi Thanh Nhan also bribed the aforementioned former leaders. Mr. Nguyen Nhan Chien confessed that from 2014 until his retirement in 2020, on holidays and Tet occasions, he received gifts from Ms. Nhan.
In total, Ms. Nhan visited Mr. Chien’s office at the headquarters of the Bac Ninh People’s Committee and Provincial Party Committee 13 times, giving him between VND 500 million and 3 billion VND each time, totaling VND 13 billion. Therefore, Mr. Chien was accused of receiving bribes of VND 14 billion from AIC Company and Song Hong Company.
The former Secretary of Bac Ninh confessed that he had spent all the money, but now he and his family have voluntarily returned VND 14 billion to the investigating agency to remedy the damage.
Similarly, Mr. Nguyen Tu Quynh, in his capacity as Vice Chairman and then Chairman of the Bac Ninh People’s Committee, also received money from Nguyen Thi Thanh Nhan and Song Hong Company on many occasions, with a total of VND 10.1 billion in illegal benefits.
In this case, the accused Nguyen Thi Thanh Nhan and Nguyen Hong Son, former deputy general director of AIC, are at large. Both are wanted by the Investigation Police Agency of the Ministry of Public Security, with Ms. Nhan being wanted nationwide, internationally, and especially.
The Supreme People’s Procuracy called on the accused Nhan and Mr. Son (currently at large) to turn themselves in to the nearest police or procuracy agency to receive leniency. If they continue to flee, they will be considered as “giving up their right to self-defense” and will still be prosecuted and tried in accordance with the law.
