The Ho Chi Minh City People’s Committee Office has recently issued an urgent document seeking comments from the city’s People’s Committee members on two draft decisions regarding permitting construction projects with basements.

The first draft decision proposes to supplement the regulation on underground space planning into the management rules for the approved 1/2000 scale detailed urban construction planning (subdivision planning) of the 930-hectare existing Ho Chi Minh City center, which was approved in 2012.

The second draft decision aims to supplement the underground space planning content into the management regulations according to the approved 1/5000 and 1/2000 scale subdivision planning and 1/2000 scale detailed planning.

The solicitation of comments on these two draft decisions stems from a proposal by the Department of Planning and Architecture to address challenges in urban underground space planning and granting construction permits for projects with basements.

During a meeting on September 9, the Ho Chi Minh City Party Committee agreed with the proposal and instructed the People’s Committee to urgently review and advise on a document seeking comments from members within three working days.

Based on this feedback, the People’s Committee will consider and approve the two decisions to resolve issues related to planning and granting construction permits for projects with basements in the city.

As previously reported by VietNamNet, for almost a year, households in Ho Chi Minh City with a need to construct detached houses with basements have been unable to obtain construction permits.

According to the Department of Construction, this challenge arose because the city’s master plan in 2010 and the previously approved 1/2000 scale detailed planning did not include urban underground space planning.

As the subdivision planning did not cover underground space, the establishment, appraisal, and approval of detailed construction planning through the expedited procedure could not be executed. This is a prerequisite for developing investment projects and granting construction permits.

The Department of Planning and Architecture shared that the adjusted master plan for Ho Chi Minh City towards 2040, with a vision towards 2060, is currently under appraisal by the Ministry of Construction. This adjusted plan identifies areas encouraging the construction of underground works and organizing underground space.

Upon approval by the Prime Minister, the adjusted master plan will serve as a foundation for Ho Chi Minh City to implement underground space planning for subdivision and detailed planning.

Currently, Ho Chi Minh City has over 600 approved subdivision planning schemes in effect. However, apart from the subdivision planning for the 930-hectare existing center, the remaining schemes lack specific regulations regarding basement construction for detached houses.

While awaiting the completion of legal provisions, the Department of Planning and Architecture proposed that the People’s Committee supplement the underground space planning content into the subdivision and detailed construction planning with a scale of 1/2000.

This will facilitate the granting of construction permits for detached houses with basements in areas lacking detailed planning at a scale of 1/500, urban design, or architectural management regulations governing basement construction.
