On September 18, the Supreme People’s Procuracy of Vietnam issued an indictment charging 15 defendants in a case involving “Violation of regulations on the management and use of state assets, leading to loss and waste; Negligence causing serious consequences; Bribery; Abuse of position and power to gain advantages for others” at Cross-Vietnam Oil Trading and Tourism Company and several related agencies and organizations.

Le Duc Tho, former Secretary of the Provincial Party Committee of Ben Tre (from July 2021 to September 2023), was indicted on charges of “Abuse of position and power to gain advantages for others” and “Receiving bribes.”

Do Thang Hai, former Deputy Minister of Industry and Trade, was indicted on charges of receiving bribes. Tran Duy Dong, former head of the Domestic Market Department, Ministry of Industry and Trade (before being prosecuted, he was Deputy Director of the Trade Promotion Department – Ministry of Industry and Trade), was charged with ‘Receiving bribes.’

Mai Hong Hanh, former Director and Chairman of the Members’ Council of Cross-Vietnam Oil Trading and Tourism Company, was indicted on charges of “Violation of regulations on the management and use of state assets, causing loss and waste” and “Offering bribes.”

According to the investigation results, from August 2016, Mai Thi Hong Hanh was the legal representative, Director, and Chairman of the Members’ Council, as well as the de facto owner of Cross-Vietnam Oil Company.

In her management of the company’s gasoline business, Hanh took advantage of her position and authority as the company’s representative, owner, and the authority vested by the State in managing and using the Price Stabilization Fund and the task of collecting and remitting environmental protection taxes to the state budget to commit crimes.

Specifically, Hanh violated regulations on the management and use of the Price Stabilization Fund and environmental protection taxes, causing a loss of state assets totaling over VND 1,436 billion.

The accused also bribed Do Thang Hai (former Deputy Minister of Industry and Trade), Tran Duy Dong (former head of the Domestic Market Department, Ministry of Industry and Trade), Hoang Anh Tuan (former deputy head of the Domestic Market Department), Nguyen Loc An (former deputy head of the Domestic Market Department), Phan Kien Anh (former director of the Distribution Branch). Products of Nghi Son Refinery), Dang Cong Khoi (former deputy head of the Price Management Department), Le Duy Minh (former head of Ho Chi Minh City Tax Department), and Le Duc Tho (former Chairman of Ben Tre Province) with a total amount of USD 1,265,000 (equivalent to over VND 29 billion) and VND 900 million.

In relation to the case, Mr. Le Duc Tho was accused of receiving bribes twice, totaling more than USD 600,000 (equivalent to over VND 13.8 billion) from Ms. Mai Thi Hong Hanh.

In addition, Mr. Tho also took advantage of his position and power to influence others for personal gain. Specifically, the accused influenced the director of Vietinbank’s Ben Tre branch to provide Vietnam Oil Company with favorable loan conditions, including a credit limit of VND 400 billion, preferential interest rates, and a 40% unsecured loan ratio.

Mr. Tho received money and valuable assets from Ms. Hanh on several occasions, including: USD 200,000 (equivalent to over VND 4.5 billion) on March 28, 2022; a set of golf clubs worth VND 1.1 billion; a Patek Philippe watch worth USD 421,000 (equivalent to over VND 9.8 billion); and a Mercedes Benz S450 Luxury car worth over VND 6.6 billion.

The investigating authorities stated that during the investigation process, Mr. Tho confessed to his crimes, showed remorse, and actively cooperated with the authorities in detecting and investigating the crimes. He also voluntarily turned in VND 2.2 billion and requested to use the temporarily seized money to compensate for the damage caused.
