What Type of Real Estate Transaction Will Ho Chi Minh City Tax Department Soon Streamline?

Amidst the backlog of thousands of real estate dossiers that have been stalled for over a month, the tax industry in Ho Chi Minh City has devised a solution to facilitate certain transfer and donation transactions.

Speaking to Nguoi Lao Dong reporters on the morning of September 19, a leader of the Ho Chi Minh City Tax Department shared that to unblock a portion of the over 8,000 stagnant real estate dossiers, which were pending guidance from the Ho Chi Minh City People’s Committee on applying the new or old land price framework, the Tax Department has instructed relevant units to process certain real estate transfer and donation dossiers.

Specifically, real estate transfer dossiers for sellers who own only one property and those involving the donation of real estate among close relatives will be prioritized for resolution.

Since these transactions are exempt from personal income tax, the procedures for resolving the dossiers of sellers with a single property and donors are not dependent on the land price framework used for tax calculation.

Regarding real estate transactions, the lack of a new land price framework from Ho Chi Minh City has caused significant bottlenecks in handling real estate transfer dossiers, land-use purpose conversions, and other procedures since the 2024 Land Law took effect on August 1.

To address this issue, the Ho Chi Minh City Tax Department recently proposed to the city administration that for dossiers arising from August 1 until the date before the Ho Chi Minh City People’s Committee issues a decision to adjust the new land price framework, the old land price framework from the 2020-2024 period should be applied.

“If the Ho Chi Minh City People’s Committee agrees to apply the old land price framework, the tax authority will focus on resolving and unblocking the backlog of real estate dossiers,” the leader of the Ho Chi Minh City Tax Department stated.
