The Big Billion Scandal: Former Director of Construction Faces Justice

A former director of the Đắk Nông Province Construction Department and his subordinates are facing legal consequences for their negligence, which led to a severe collapse at a billion-dollar project.

On the morning of September 26, the People’s Court of Dak Nong province opened a first-instance trial for a case that occurred at the technical infrastructure project inside and outside the fence of Nhan Co Industrial Park (abbreviated as Nhan Co Industrial Park project).

However, at the beginning of the trial, the court clerk announced that the representative of the VKSND, who was to prosecute at the trial, was ill. In addition, one of the defense lawyers for the accused had requested a postponement due to a scheduling conflict. After consideration, the Council decided to adjourn the trial and reschedule it for October 16, 2024.

In this case, four defendants were prosecuted for the crime of negligence causing serious consequences, including Mr. Dang Gia Dung (65 years old, former Director of the Department of Construction), Ho Sy Diep (59 years old, former Deputy Director of the Project Management Board). Investment Construction (PMU) of Dak Nong province), Tran Quoc Dat (43 years old, former Head of Project Room 1 of the PMU), and Dang Thai Son (42 years old, former specialist of the Quality Management Room for construction works of the Department of Construction).

The project experienced five land subsidence incidents, causing losses of over VND 55 billion

Two defendants were prosecuted for violating regulations on construction, causing serious consequences: Pham Van Cuu (49 years old, General Director of Duong Viet Investment and Construction Joint Stock Company) and Nguyen Thanh Ha (62 years old, Head of Design Room 1 of the company).

The Nhan Co Industrial Park project was approved by the People’s Committee of Dak Nong province in 2015, with a total area of 148 hectares and a total investment of over VND 1,600 billion.

From 2018 to 2020, there were five incidents of land subsidence in the ground leveling and slope protection items (Package 02XL) of the Nhan Co Industrial Park project, causing losses of over VND 55 billion.

The main reason was that the above individuals did not fully comply with the construction law regulations, did not monitor groundwater levels to assess the impact of water on the stability of Package 02XL.

The design documents were not in accordance with the regulations, but Mr. Dung trusted the appraisal results of Mr. Son and signed the announcement of the appraisal results and the decision to approve the design documents and construction drawings of the project without further checking and verifying the appraisal contents.
