On November 19, at the specialized session, the Hanoi People’s Council passed a regulation on the application of measures to request the discontinuation of electricity and water supply services as stipulated in the Capital Law.

The regulation consists of 10 articles and applies to investors, organizations, and individuals who have signed contracts with electricity and water supply service providers regarding construction, management, and the use of structures, production facilities, business, and services.

The regulation clearly states that structures will have their utilities disconnected when they have been requested by authorized agencies or individuals to cease illegal activities and stop construction in writing, but the violating organizations or individuals refuse to comply.

Specifically, the cases for utility disconnection include:

– Structures built in violation of planning regulations or without a construction permit when one is required by law.

– Structures built that deviate from the content of the construction permit or the approved design when exempt from obtaining a construction permit.

– Structures built on land that has been encroached upon, as defined by land laws.

– Structures that are required to undergo fire protection design appraisal but are constructed without a certificate or appraisal conclusion.

– Structures built that do not adhere to the approved fire protection design.

– Structures, production facilities, business, and services that have not been inspected and approved for fire protection but have been put into operation and had their activities suspended, yet the violating organizations or individuals refuse to comply.

– Business facilities providing karaoke or nightclub services that do not meet fire protection safety conditions and have been suspended, but the violating organizations or individuals refuse to comply.

– Structures that are subject to demolition and have an emergency relocation decision issued by a competent authority, but the organizations or individuals concerned do not carry out the relocation despite persuasion and exhortation.

According to the regulation, within two days of receiving the inspection report and proposal, the functional unit will issue a decision to disconnect utilities from the violating structure.

The decision to terminate the application of measures to request the discontinuation of utility services must be sent to the utility service providers and the violating organizations or individuals within one day of the decision being made.

Utility service providers will resume the supply of electricity and water within 24 hours of receiving the decision to terminate the application of measures to request the discontinuation of utility services from the authorized person.
