The Chairman of the People’s Committee of Bac Giang province has just issued an administrative penalty decision against the Management Board of Investment Project Construction of Yen Dung district, with Mr. Nguyen Van Son as the legal representative.
The Management Board of Investment Project Construction of Yen Dung district has committed an administrative violation by constructing the project without an approved decision on the assessment report of the environmental impact assessment.
Specifically, the resettlement land project for the construction of Dong Viet Bridge and the approach road to the bridge in Dong Phuc commune has the Investment Project Management Board of Yen Dung district as the investor, with a project scale of about 2 hectares.
According to the report of the Investment Project Management Board of Yen Dung district and the excerpt of the land cadastral map, the land area used for the project implementation is 1.71 hectares, of which the land area requiring conversion of rice land use purpose from 2 turns onwards is 1.71 hectares.
Comparing with the provisions of environmental law, this project is an investment project of Group II, which is subject to environmental impact assessment and the competence to approve the environmental impact assessment report of the project belongs to the People’s Committee of the provincial level.
However, the Investment Project Management Board of Yen Dung district proceeded with the project: organizing land leveling, road leveling, installing light poles, etc., without an approved decision on the assessment report of the environmental impact assessment as prescribed.
Based on the violation, the People’s Committee of Bac Giang province decided to impose an administrative fine of VND 350 million on the Investment Project Management Board of Yen Dung district and simultaneously suspend the construction of the above items in the resettlement land project for the construction of Dong Viet Bridge and the approach road to the bridge for a period of 9 months to remedy the violation.
