The Chairman of the People’s Committee of Bac Giang province has just issued an administrative penalty decision against the Management Board of Investment Project Construction of Yen Dung district, with Mr. Nguyen Van Son as the legal representative.
The Management Board of Investment Project Construction of Yen Dung district has committed an administrative violation by constructing the project without an approved decision on the assessment report of the environmental impact assessment in accordance with regulations.
Specifically, the resettlement land project for the construction of Dong Viet Bridge and the approach road to the bridge in Dong Phuc commune, with the Management Board of Investment Project Construction of Yen Dung district as the investor, has a project scale of about 2 hectares.
According to the report of the Management Board of Investment Project Construction of Yen Dung district and the excerpt of the land cadastral map, the land area used for the project implementation is 1.71 hectares, of which the area of land requiring a change of land use purpose from 2 rice crops or more is 1.71 hectares.
In comparison with the environmental legal regulations, this project is classified as an investment group II, which is subject to an environmental impact assessment and the approval authority of the environmental impact assessment report of the project is the People’s Committee of the provincial level.
However, the Management Board of the Yen Dung District Investment Project illegally implemented the project by organizing land leveling, road subgrade leveling, and street light pole installation without an approved decision on the assessment report of the environmental impact assessment as prescribed.
Based on the violation, the People’s Committee of Bac Giang province decided to impose an administrative fine of VND 350 million on the Management Board of Investment Project Construction of Yen Dung district and simultaneously suspend the construction of the items in the resettlement land project for the construction of Dong Viet Bridge and the approach road to the bridge within 9 months to remedy the violation.
