According to the Hanoi Police Department’s website, on December 3, 2024, the Hanoi Police Investigation Agency decided to detain several individuals: Pham Ngoc Tuan, Ngo Van Duong, Nguyen Duc Thanh, Nguyen The Trung, and Nguyen The Quan, for “Violating regulations on auction of assets.”

Prior to this, in November 2024, Pham Ngoc Tuan (DOB: 1991, permanent residence: Dong Anh town, Dong Anh district, Hanoi) learned about an auction of land-use rights in a project to construct technical infrastructure and develop rural residential areas (Dong Lai village, Quang Tien commune, Soc Son district, organized by the People’s Committee of Soc Son district). He then asked Ngo Van Duong (DOB: 1994, permanent residence: Xuan Non commune, Dong Anh district, Hanoi) to purchase the auction dossier issued by Thanh Xuan Company (address: Nhan Chinh ward, Thanh Xuan district, Hanoi) – the unit coordinating the auction.

To ensure winning the desired land lots, Pham Ngoc Tuan colluded with Nguyen Thi Quynh Lien (DOB: 1981, permanent residence: Nguyen Khe commune, Dong Anh district, Hanoi), Nguyen Duc Thanh (DOB: 1992, permanent residence: Lam Lang, Van Duong ward, Bac Ninh city, Bac Ninh province), Nguyen The Trung (DOB: 1994, permanent residence: Xuan Non commune, Dong Anh district, Hanoi), Nguyen The Quan (DOB: 1994, permanent residence: Xuan Non commune, Dong Anh district, Hanoi), and Ngo Van Duong (DOB: 1994, permanent residence: Xuan Non commune, Dong Anh district, Hanoi) to participate in the auction and agreed to manipulate the bidding process.

Specifically, Tuan provided a reference price for each land lot, which he had calculated and prepared beforehand. According to this table, the land lots ranged in value from approximately 20 million VND to 32 million VND per square meter, estimated at 1.7 billion VND – 3.9 billion VND per lot.

The group agreed that this was the maximum price they were willing to pay for each lot. If, by the fourth round of bidding, the highest bidder was still below Tuan’s predetermined price, the group would continue to the fifth and sixth rounds but would not exceed the agreed-upon maximum. If, however, by the fourth round, the highest bid exceeded their maximum, they would place an abnormally high bid in the fifth round but then drop out in the final (sixth) round.

By doing so, the auction would have to be stopped and rearranged for another time, as per regulations requiring six rounds of bidding. In this scenario, the group would not lose their deposit, and they would have another opportunity to participate in the auction and acquire the desired land lot.

To execute their plan, the group transferred money to Duong and Tuan, who then transferred a total of VND 3.616 billion to Thanh Xuan Company as a deposit for the land auction.

During the auction on November 29, 2024, the group initially bid according to the agreed-upon prices. However, when they noticed that the bids for 36 out of 58 land lots exceeded their predetermined maximum, they placed abnormally high bids in the fifth round, with Pham Ngoc Tuan even offering over VND 30 billion per square meter (approximately 12,000 times the starting price). As a result, the auction of these 36 land lots was unsuccessful.

Given the unusual circumstances of the auction, the Director of the Hanoi Police Department instructed the Police Department for Corruption, Economic, Smuggling, and Environmental Crime Investigation to coordinate with relevant units to promptly investigate and clarify the illegal activities of the involved individuals. Additionally, the Director ordered the functional units to strengthen inspection, timely detection, strict handling, and prevention of acts that take advantage of policies and laws to violate legal provisions in the field of asset auction, particularly land-use rights auction, in the city.

The Hanoi Police Investigation Agency is currently consolidating documents and evidence to prosecute the case and punish the involved individuals in accordance with the law.
