On December 12, the Ho Chi Minh City People’s Court confirmed that Truong My Lan, former chairman of the Van Thinh Phat Group, had filed an appeal against the entire first-instance verdict handed down by the Ho Chi Minh City People’s Court in the second phase of the trial.

In this phase, the Ho Chi Minh City People’s Court tried 34 defendants, including leaders and senior officials of the Van Thinh Phat Group, Saigon Joint Stock Commercial Bank (SCB), and related organizations.

The Court held that Truong My Lan played a dominant role in SCB and agreed with Nguyen Phuong Hong’s proposal to borrow subsidiaries of the Van Thinh Phat Group to issue bonds. Lan implemented deceitful schemes to appropriate VND 30,081 billion from over 35,000 victims, establishing fictitious transactions and transferring money across borders. Therefore, Lan bears the highest responsibility in this case.

Defendant Truong My Lan

The Court sentenced Truong My Lan to life imprisonment for “Fraudulent Appropriation of Property,” 12 years’ imprisonment for “Money Laundering,” and eight years’ imprisonment for “Illegal Cross-border Transfer of Currency.” The cumulative sentence is life imprisonment.

In addition to Lan, 28 defendants appealed for reduced sentences, including Truong Hue Van (Lan’s niece), Vo Tan Hoang Van (former CEO of SCB), and Tran Thi My Dung (former SCB Vice President).

In this phase, Chu Lap Co was sentenced to two years in prison for “Money Laundering,” but he did not appeal.

Additionally, the court received appeals against the first-instance verdict in the second phase from individuals and entities with related rights and obligations.

Specifically, Amaland Private Enterprise and Sing Viet Urban Development and Resettlement Joint Stock Company appealed regarding the Sing Viet Urban Area and Resettlement Area project in Binh Chanh District. Truong Lap Hung appealed to request the unfreezing of his bank account. SCB appealed regarding the handling of evidence related to the bank in the case. Tan Viet Securities (TVSI) appealed concerning the seizure of assets, the recovery of shares, and the lifting of transaction restrictions.

On December 3, the Ho Chi Minh City High-Level People’s Court upheld the death sentence for Truong My Lan in the Van Thinh Phat case’s first phase.

Lam Minh Van and Lam Thanh Binh appealed for the retrieval of assets in the case. Ton Thi Thanh Hoang appealed regarding the restricted assets related to Nguyen Tien Thanh. Nguyen Thanh Phuong appealed about the handling of evidence related to Nguyen Phuong Hong.

Moreover, many victims who invested in the bonds also appealed the first-instance verdict. Some victims appealed because they were not included on the list of victims, while others requested the payment of interest and principal according to the signed bond purchase contracts.
