The Ministry of Public Security’s Investigation Agency has recently concluded its investigation and transferred the case file to the Supreme People’s Procuracy, recommending the prosecution of 30 accused individuals involved in the serious irregularities at Thuân An Joint Stock Group and several related units. The accused are charged with “Violation of bidding regulations causing serious consequences,” “Abuse of position and power to influence others for personal gain,” and “Abuse of position and power while performing official duties.”
The investigation concluded that the accused, Mr. Pham Thanh Binh, former Director of the Project Management Board, colluded with representatives of contractors, including Thuân An Group, Huy Hoang Construction Co., Ltd., and Bridge 75 Joint Stock Company, to rig the bidding process.
During the bidding, the aforementioned trio of contractors was selected to construct Package 13 (bridge construction), valued at over VND 706 billion. Mr. Binh received a total of more than VND 9.4 billion from these contractors. This includes: USD 10,000 from Mr. Nguyen Duy Hung, Chairman of Thuân An Group, as a “congratulatory” gift for Mr. Binh’s appointment as Director of the Project Management Board; and VND 9.2 billion from the three enterprises during their participation and implementation of the project.
According to his statement, Mr. Binh used the received funds as follows: VND 5 billion was transferred to the People’s Committee Office of Quang Ninh Province to “support expenses for the province’s common activities,” such as organizing conferences, hospitality, guest receptions, and other external relations events; VND 1 billion was used for Tet bonuses for the Project Management Board’s deputy directors in 2023; and the remaining amount of over VND 3.4 billion was utilized for personal purposes and internal operational costs of the Project Management Board.
Bid-rigging erodes public trust
The investigative agency assessed that the actions of Mr. Pham Thanh Binh, Director of the Project Management Board, and the related accused individuals distorted the objectivity and transparency of the bidding process. This severely impacted fair competition, resulting in state property losses and a decline in public trust regarding the management of public investment projects.
As of the conclusion of the investigation, Mr. Pham Thanh Binh had voluntarily returned over VND 4 billion as compensation for the damages caused. This is considered a mitigating circumstance under the Penal Code.
The investigation agency has proposed that the Supreme People’s Procuracy prosecute Mr. Binh for “Violation of bidding regulations causing serious consequences,” in accordance with Article 222 of the 2015 Penal Code, amended and supplemented in 2017.
Additionally, the investigation concluded that during the construction of the aforementioned package, the accused, Mr. Nguyen Duy Hung, negotiated labor prices with subcontractors to gain a differential of over VND 2.1 billion. This was intended to compensate for the costs of “lobbying and bribing.”
