Proposed Decree to Fine Traffic Violations Up to 60 Million VND: Chairman and Police Chief of the Commune

To enforce the Law on Roads, the Ministry of Construction is consulting on a draft decree on administrative sanctions for road-related offenses. Notably, the draft proposes that the chairman and police chief of a commune be authorized to fine road traffic violations of up to 60 million VND.

This decree stipulates the acts of administrative violations, the forms and levels of punishment, and remedial measures for each act of administrative violation in the field of roads. It also defines the authority to establish records, the authority to impose sanctions, and the specific monetary penalty levels according to the position for violations in the road sector.

In the draft, the Ministry of Construction proposes to supplement the regulation: The Chairman of the People’s Committee of the commune level is authorized to fine up to 60 million VND, and the Chairman of the People’s Committee of the provincial level can fine up to 75 million VND. Both have the right to issue a warning, revoke licenses or practice certificates for a certain period, or temporarily suspend operations; confiscate contraband and means of violation.

The Director of Provincial-level Public Security, the Director of the Traffic Police Department, the Director of the Social Order Administration Police Department, the Commander of the Mobile Police, and the Director of the Vietnam Road Administration are authorized to issue warnings, fine up to 75 million VND, revoke licenses or practice certificates for a specified period, and confiscate contraband and means of violation.

Commune-level Police Chief Authorized to Fine Traffic Violations Up to 60 Million VND

The draft also stipulates the sanctioning authority of the People’s Police. Accordingly, a People’s Police officer on duty is authorized to issue a warning, fine up to 7.5 million VND, and confiscate contraband and means of violation worth no more than 15 million VND.

The head of a company-level mobile police unit, the head of a station, and the team leader of a People’s Police officer on duty have the authority to issue warnings and fine up to 15 million VND, in addition to confiscating contraband and means of violation worth no more than 30 million VND.

The head of a commune-level police station, the head of a border gate police station or export processing zone, and the battalion commander of a mobile police battalion are authorized to issue warnings, fine up to 22.5 million VND, and confiscate contraband and means of violation worth no more than 45 million VND.

Meanwhile, the police chief of a commune, the head of a professional department under the Traffic Police Department, the head of a professional department under the Social Order Administration Police Department, and the head of a provincial-level police department (including the Head of the Social Order Administration Police Department, the Head of the Traffic Police Department, the Head of the Mobile Police Department, and the Commander of the Mobile Police Battalion) are authorized to issue warnings, fine up to 60 million VND, revoke licenses or practice certificates for a specified period, and confiscate contraband and means of violation worth no more than 120 million VND.

The consultation period for this draft will last until September 1st, 2025.
