To enforce the Road Law, the Ministry of Construction is collecting opinions on the draft Decree on administrative sanctions for road-related offenses. Notably, the draft proposes that commune-level People’s Committee Chairpersons and commune-level police chiefs be authorized to impose traffic fines of up to 60 million VND.

This Decree stipulates the administrative violations, forms, and levels of punishment, as well as remedial measures for each violation in the road sector. It also specifies the authority to establish records, the authority to impose sanctions, and the fine amounts for each position.
In the draft, the Ministry of Construction proposes to supplement the regulation: Commune-level People’s Committee Chairpersons are authorized to impose fines of up to 60 million VND, while provincial-level People’s Committee Chairpersons can impose fines of up to 75 million VND. Both levels of chairpersons are empowered to issue warnings, revoke permits or licenses, impose temporary bans, and confiscate violating assets or tools.
The draft also outlines the sanctioning authority of the People’s Police, with police officers on duty authorized to issue warnings, impose fines of up to 7.5 million VND, and confiscate violating assets or tools worth no more than 15 million VND.
For police officers holding the position of company-level commanders in mobile police units, station chiefs, and chiefs of police stations at border gates and export processing zones, the draft proposes the authority to issue warnings, impose fines of up to 15 million VND, and confiscate violating assets or tools worth no more than 30 million VND.
Similarly, police chiefs at the commune level, heads of professional departments under the Traffic Police Department, heads of professional departments under the Social Order Administration Police Department, and provincial-level police chiefs (including heads of social order administration, traffic police, and mobile police) are authorized to issue warnings, impose fines of up to 60 million VND, revoke permits or licenses, impose temporary bans, and confiscate violating assets or tools worth no more than 120 million VND.
The consultation period for this draft will last until September 1st, 2025.
