The Ministry of Home Affairs has issued a document responding to the proposal regarding the organization, personnel, and implementation of policies and regimes during the implementation process of the two-level local government.

Regarding the organization and operation of hamlets, residential groups, the Department of Home Affairs of Dak Lak province reflected that after the administrative arrangement of communes and wards, some hamlets and residential areas no longer meet the household criteria due to adjustments in administrative boundaries.

What is the procedure for building a project to merge residential clusters into existing hamlets and residential groups?

The Ministry of Home Affairs is developing new policies for non-specialized staff.

According to the Law on Organization of Local Government, the competence to establish, reorganize, dissolve, name, and rename hamlets belongs to the People’s Council at the communal level.

However, up to now, the Ministry of Home Affairs has not promulgated or amended the Circulars to guide the organization and operation of hamlets and residential groups suitable for the model of two-level local government.

In addition, the terms of office of hamlet, bon, residential group, and block chiefs have expired. Given this situation, the locality proposed that the Ministry of Home Affairs issue a document to guide the implementation of the locality.

Voting procedure for hamlet and residential group leaders

On this issue, the Ministry of Home Affairs stated that the Law on Organization of Local Government has prescribed the competence to establish, reorganize, dissolve, name, and rename hamlets and residential groups of the People’s Council at the communal level.

At the same time, to implement the organization and operation of hamlets and residential groups in the context of administrative arrangement and implementation of the two-level local government model, the Ministry of Home Affairs has Document No. 4168/BNV-CQĐP dated June 23, 2025.

In this document, the Ministry of Home Affairs has guided the identification of communal-level community organization models (new), the conversion of hamlets into residential groups or vice versa, and the renaming of hamlets and residential groups in case of name coincidence.

The Ministry of Home Affairs is developing a draft Decree on the organization and operation of hamlets and residential groups, including regulations on policies and regimes for non-specialized staff, to submit to the Government for consideration and promulgation.

Regarding the contents related to the voting procedure for hamlet and residential group leaders, according to the Ministry of Home Affairs, this issue is prescribed in the Law on Grassroots Democracy and Decree No. 59/2023/ND-CP dated May 15, 2023, of the Government.

“These regulations are currently in effect and remain valid when implementing the two-level local government model,” said the Ministry of Home Affairs.

According to Decision 1589 dated July 24, signed by Deputy Prime Minister Nguyen Hoa Binh, the Ministry of Home Affairs was assigned to chair and coordinate with relevant ministries and branches to develop a Government Decree on the organization and operation of hamlets and residential groups and a number of policies and regimes for non-specialized staff in hamlets and residential groups. This task must be completed by November 2025.
