The Ministry of Construction is seeking feedback on a draft decree on administrative sanctions for road-related offenses, which includes a notable proposal to expand the authority to penalize traffic violations to local leadership levels.

Specifically, the draft proposes that the Chairman of the Provincial People’s Committee be authorized to impose administrative fines of up to VND 75 million for traffic violations, while the Chairman of the Commune People’s Committee can impose fines of up to VND 60 million.

Both the Commune and Provincial People’s Committee Chairmen will have the power to issue warnings, revoke licenses or practice certificates for a specified period, suspend operations, and confiscate violating objects or means.

Additionally, the draft decree outlines the authority of road management agencies to impose sanctions. The head of the regional road management agency under the Vietnam Road Administration is authorized to issue warnings, impose fines of up to VND 37.5 million, revoke licenses or practice certificates, suspend operations, and confiscate violating means.

The Director of the Department of Construction and the Head of the Inspection Team of the Ministry of Construction are also authorized to impose fines of up to VND 60 million, in addition to other sanctions such as warnings or suspension of operations.

Another notable aspect of the draft decree is the expansion of traffic violation sanctioning authority to the People’s Police Force. Police officers on duty will be authorized to impose fines of up to VND 7.5 million and confiscate violating objects or means with a value not exceeding VND 15 million.
The head of the mobile police unit at the company level, the station/team leader of the police officers on duty, in addition to having the authority to issue warnings, can impose fines of up to VND 15 million and confiscate violating objects or means with a value not exceeding VND 30 million.
The head of the Commune Police Station, the head of the Police Station at the border gate, the export processing zone, and the mobile police battalion commander are authorized to issue warnings, impose fines of up to VND 22.5 million, and confiscate violating objects or means with a value not exceeding VND 45 million.

Meanwhile, the head of the Commune Police, the head of the professional department under the Traffic Police Department, the head of the professional department under the Police Department for Administrative Management of Social Order and Safety, and the head of the Provincial Police Department (including the head of the Police Department for Administrative Management of Social Order and Safety, the head Traffic Police Department, Head of Mobile Police Department, Mobile Police Regiment Commander) are authorized to issue warnings, impose fines of up to VND 60 million, revoke licenses or practice certificates for a specified period, suspend operations, and confiscate violating objects or means with a value not exceeding VND 120 million.

The Director of Provincial Police, the Director of the Traffic Police Department, the Director of the Police Department for Administrative Management of Social Order and Safety, the Commander of Mobile Police, and the Director of Vietnam Road Administration are authorized to issue warnings, impose fines of up to 75 million VND, revoke licenses or practice certificates for a specified period, suspend operations, and confiscate violating objects or means.
The Ministry of Construction is inviting feedback on this draft decree on administrative sanctions for road-related offenses until September 1, 2025.

The new decree 168/2024/ND-CP, effective from January 1, 2025, introduces a demerit point system for traffic violations. Drivers will face administrative penalties and have 2 to 10 points deducted from their driving licenses. Failure to obey traffic signals or the instructions of a traffic controller, as well as driving against the flow of traffic, will result in a 4-point deduction.
