From now until the end of the year, several social housing projects in Hanoi are expected to be eligible for sale and accept applications for purchase or rent-to-own, with prices ranging from over 18 to 27 million VND per square meter.

With prices 2-3 times lower than the current apartment market, information about the procedure for purchasing social housing has attracted the attention of many.

A citizen asked a question based on point d, clause 1, Article 79 of the 2023 Housing Law. Accordingly, in addition to the 12 groups of subjects eligible to buy social housing, the law also stipulates 5 priority groups, including: people with revolutionary merits, relatives of martyrs, disabled people, those arranged for resettlement in the form of buying or renting social housing, and women.

In case a subject is entitled to multiple support policies, they shall be entitled to the highest level of support. If multiple subjects meet the criteria and conditions for purchasing social housing, the investor will consider them in order of priority as mentioned above.

According to the above regulations, the citizen wondered how the term “women” in this case should be understood. Does it refer to all women who meet the conditions for buying social housing, or only single women, or only women who belong to other priority groups such as people with revolutionary merits, relatives of martyrs, disabled people, or those arranged for resettlement?

In response to this query, the Ministry of Construction stated that point d, clause 1, Article 79 of the 2023 Housing Law stipulates: “In case the subjects have the same criteria and conditions, support shall be given in order of priority to: people with revolutionary merits, relatives of martyrs, disabled people, those arranged for resettlement in the form of buying or renting social housing, and women.”

Article 38, Clause 2 of Decree No. 100/2024 of the Government, detailing a number of articles of the Housing Law on the development and management of social housing, clearly states: “The list of priority groups is arranged according to the order of the time of application submission. Apartments for priority subjects are arranged according to the order of the priority list until fully allocated, and the remaining subjects will then participate in a lottery.”

Articles 29 and 30 of Decree No. 100/2024 detail the specific conditions regarding housing and income of applicants for social housing, whether they are single or married according to the law.

Appendix II, Form No. 01 of Decree No. 100/2024 prescribes the application form for purchasing, renting to own, or renting social housing. The section on the applicant’s information includes specific details such as full name and monthly income…

Based on the above provisions, the Ministry of Construction clarified that current laws only stipulate the order of priority, the method of determining the list, and the allocation of apartments according to that list. Among the priority groups, women are the fifth priority.

“The law does not discriminate whether the applicant is a single or married woman. Regardless of their marital status, applicants for social housing must meet the conditions regarding housing and income as specified in Articles 29 and 30 of Decree 100/2024,” emphasized the Ministry of Construction.
