Vietnam’s National Competition Committee, under the Ministry of Industry and Trade, has recently imposed a fine of VND 200 million on the Joint Stock Company for Fast Delivery Services for providing misleading information to customers about enterprises, products, and services to attract customers from other enterprises, in violation of the Law on Competition.

For similar violations, the National Competition Committee also imposed a fine of VND 200 million each on the Limited Liability Company Express Delivery, SPX Express Joint Stock Company, and TikiNow Smart Logistics Joint Stock Company.

These companies were forced to publicly rectify the misleading information about their enterprises, products, and services on their electronic information pages.

Thus far, the National Competition Committee has reviewed and penalized four enterprises in the postal sector for engaging in unfair competition practices prohibited by the 2018 Law on Competition.

Delivery companies need to scrutinize their promotional content

According to the Ministry of Industry and Trade, Vietnam’s e-commerce continues to maintain an impressive growth rate of 18-25% annually. By 2024, the market size is expected to exceed USD 25 billion, a 20% increase from 2023, accounting for approximately 9% of the country’s total retail sales of goods and service revenue.

The development of e-commerce presents significant opportunities for logistics and delivery companies, with strategies such as timed deliveries and after-sales services.

However, the National Competition Committee advises businesses operating in the postal sector to proactively review their promotional content, including information about their enterprises, products, and services provided to partners and customers. This includes scrutinizing their website content approval processes and sales documents to ensure that all information has a clear legal and scientific basis. Such measures aim to prevent risks and control violations related to unfair competition practices prohibited by the 2018 Law on Competition.

For instance, TikiNow Smart Logistics Joint Stock Company had to modify its website information, which previously stated: 100% nationwide delivery coverage; Over 1 million daily orders; Over 100 thousand orders processed daily by TikiNow.

The company rectified this information to: Delivery coverage expanded to 34 provinces and cities; Over 1 million orders processed monthly; Capacity to handle over 100 thousand orders daily.
