A part-time freelance worker with unstable monthly income totaling less than VND 150 million per year is looking to purchase social housing.

When contacting the Ward People’s Committee for the procedure, this person was informed that there are no specific guidelines on income confirmation in this case. Meanwhile, according to the citizen’s understanding, the Ward People’s Committee only needs to certify the declaration.

If the Ward People’s Committee certifies the declaration, will the two documents of income determination and object confirmation meet the conditions for the Department of Construction to approve? What should people do to comply with the regulations?

In response to the above issue, the Ministry of Construction affirmed that the housing law has specific regulations and guidelines on object confirmation and income conditions for low-income earners in urban areas (without employment contracts)

According to Point b, Clause 2, Article 30 of Decree No. 100/2024/ND-CP, if single, the monthly income must not exceed VND 15 million; if married, the total monthly income of both husband and wife must not exceed VND 30 million.

Within 7 days from the date of receipt of the request for confirmation, the commune-level People’s Committee shall confirm the income conditions within 1 year immediately preceding the time the subjects specified in this Clause submit valid dossiers to the investor to register for purchase, rent-purchase of social housing.

Circular No. 05/2024 of the Minister of Construction provides detailed guidance on a number of articles of the Housing Law, which clearly states that the confirmation of the object is made by the commune-level People’s Committee of the place of permanent or temporary residence (Form No. 01, Appendix I); income confirmation is done by the commune-level People’s Committee confirming in the Income Declaration (Form No. 05, Appendix I)

If the home buyer is married, the spouse must also declare the income according to Form No. 04 or Form No. 05 as mentioned above.

The Ministry of Construction emphasizes that the declarant must commit that the information is true and take responsibility before the law for the declared content.

How to calculate income

In addition to the issue of confirming the object, many people who want to buy social housing also encounter difficulties in determining income conditions.

Specifically, a citizen uses a 12-month salary table from July 2024 to June 2025 as a basis for determining income.

From July 2024 to June 2025, the monthly salary was VND 10,879,110; including 3 specific amounts: Basic salary: VND 7,792,200; allowance for public tasks: VND 1,948,050; additional salary: VND 1,138,860.

However, in January 2025, the total income was VND 33,940,787, including the January 2025 salary of VND 10,879,110; overtime pay for the whole year of 2024, paid once in January 2025: VND 7,461,677; bonus for completing tasks well in 2024: VND 7,000,000; budget support in 2024: VND 5,500,000; salary from ranking in the 4th quarter of 2024: VND 3,100,000.

The citizen wondered if the real income was the fixed monthly amount (VND 10,879,110), the highest month (VND 33,940,787), or the average of 12 months?

Regarding this case, the Ministry of Construction quoted Decree No. 100/2024/ND-CP dated July 30, 2024, detailing a number of articles of the Housing Law, which stipulates the income conditions.

Accordingly, the income condition to be eligible to buy social housing is that the monthly income must not exceed VND 15 million for singles and VND 30 million for married couples. The monthly income to consider buying social housing is calculated as the average of 12 consecutive months prior to the dossier submission.
