Regarding planning and development in Ho Chi Minh City:

For planning that spans across two or more communal-level administrative units, or for developments that are expected to drive socio-economic growth, the People’s Committee of Ho Chi Minh City (UBND TPHCM) takes charge of organizing the planning process. The Department of Construction serves as the approving authority, while UBND TPHCM is responsible for final approval.

In the case of planning within the boundaries of a single communal-level administrative unit:

For special urban areas, Type I cities, or new cities with an equivalent population, the People’s Committee of the communal-level unit takes the lead in planning. The Department of Construction acts as the approving authority, and the People’s Committee of Ho Chi Minh City grants final approval.

For Type II, III, IV, and V cities that do not hold special political, cultural, historical, or security significance, the People’s Committee of the communal-level unit initiates the planning process. The Economic or Economic Infrastructure and Urban Development Division handles the appraisal, and the People’s Committee of the communal-level unit provides final approval.

The process of establishing, appraising, and approving the planning mission and scheme follows the 10 steps outlined in Article 16 of the Law on Urban and Rural Planning, encompassing preparation, inclusion in the planning project list, selection of consulting organizations, mission formulation and appraisal, scheme formulation and appraisal, and final approval, dissemination, and data updating.
