The Ho Chi Minh City People’s Committee Office has announced the conclusions of Vice Chairman Bui Xuan Cuong regarding the implementation of a short-term rental model for residential apartments in condominium buildings.
For apartments in mixed-use condominiums with a demand for short-term tourist rentals, the Ho Chi Minh City People’s Committee directs the departments and sectors to review and compile a comprehensive set of regulations covering housing, residency, tourism, fire safety, taxation, and other relevant areas. These regulations will serve as a basis for issuing guidance on short-term rental arrangements.
Additionally, they are to coordinate with the Ho Chi Minh City Police and the People’s Committees of wards and communes to scrutinize and publish a list of condominiums that meet the requirements for short-term tourist rentals. The deadline for completing this task is set for September 15th.

Regarding cases where there is a demand for short-term tourist rentals in condominiums that are not designated for mixed-use, the Ho Chi Minh City People’s Committee instructs the relevant departments and sectors to conduct research and propose a project to exploit these properties for economic and tourism development. This should be done while ensuring the safety and well-being of the residents in these condominiums. The deadline for completing this task is also set for September 15th.
On July 15th, the Department of Construction proposed to the Ho Chi Minh City People’s Committee a pilot program for short-term rentals in condominium apartments that meet the necessary infrastructure requirements and have the agreement of the residents. The pilot period is set for one year, commencing on September 1, 2024.
Previously, on February 27th, the Ho Chi Minh City People’s Committee issued Decision 26, based on the 2020 Housing Law, prohibiting short-term rentals in residential condominiums. This model is permitted only for tourism-specific projects like condotels and not for standard condominiums.
According to Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association, short-term rentals in condominiums cater not only to tourists but also to various transient individuals. These could include business travelers, event attendees, or those caring for family members undergoing medical treatment. Such cases do not entail a “homestay experience,” where guests share living spaces with the host.
Mr. Chau mentioned that following the issuance of Decision 26 by the Ho Chi Minh City People’s Committee, many condominium management boards and administrators have issued notices prohibiting short-term rentals since late February.
“The prohibition on short-term rentals in condominium apartments not only impacts the tourism industry but also adversely affects the livelihoods of nearly 9,000 landlords across 24 condominiums,” stated the Chairman of the Ho Chi Minh City Real Estate Association.
