This Resolution prescribes special mechanisms and policies for projects at the Gia Binh International Airport, including: Investment project for the construction of Gia Binh International Airport; Project for the construction of works ensuring the operation of Gia Binh International Airport, Resettlement project serving Gia Binh International Airport, Project for the construction of works serving the site clearance of Gia Binh International Airport, and Project for the construction of roads directly connecting Gia Binh International Airport, which will be implemented in the form of a public-private partnership.

The Resolution clearly states that the above-mentioned projects can undergo simultaneous procedures for planning adjustments and construction commencement along with the approval of investment proposals. Investors and project owners are exempt from obtaining construction permits as per the construction law and are responsible for fulfilling the conditions for construction commencement within six months from the commencement date.
According to the Resolution, the Ministry of Public Security will decide on the selection of investors for the Gia Binh International Airport construction project through a special case selection process as prescribed by the Law on Bidding before the National Assembly resolves to approve the investment proposal.
Concurrently, the Ministry of Public Security will transfer the land area and completed items of the Gia Binh Airport construction project to the People’s Committee of Bac Ninh province, who will then hand over these assets to the selected investor.
The investor undertaking the project is responsible for reimbursing the expenses incurred by the Ministry of Public Security to the state budget and the costs incurred by the People’s Committee of Bac Ninh province for land retrieval, compensation, resettlement support, and reimbursement for technical and social infrastructure, in accordance with the law.
The project for the construction of works ensuring the operation of Gia Binh International Airport will be implemented through a public-private partnership (PPP) in the form of a Build-Transfer (BT) contract, with payment to the investor sourced from the state budget. This project is exempt from obtaining an investment decision as per PPP regulations. The selection of investors for this project will follow a special case selection process, as determined in the project approval decision.
As per the Resolution, the Ministry of Public Security serves as both the managing and authorized agency for the project. They are responsible for project preparation, contract signing, and budget allocation for investor payments according to the signed BT contract.
The following projects will be implemented through a PPP in the form of a BT contract, with payment made through land funds: Resettlement project serving Gia Binh International Airport; Project for the construction of works serving the site clearance of Gia Binh International Airport; and Project for the construction of roads directly connecting Gia Binh International Airport. The selection of investors for these three projects will also follow a special case selection process and will be exempt from obtaining an investment decision as per PPP regulations.
The People’s Committee of Bac Ninh province acts as the authorized agency for these projects and is responsible for project preparation, investor selection, contract signing, and land fund allocation for investor payments according to the signed BT contract.
Additionally, Resolution No. 3 also prescribes special mechanisms and policies regarding planning, environment, and land for the aforementioned projects. This Resolution takes effect from August 14 until the completion of the projects benefiting from the special mechanisms and policies.
