The Hanoi Department of Agriculture and Environment has recently announced a list of projects that do not meet the conditions and criteria for inclusion in the pilot program under the National Assembly’s Resolution 171 (second phase) – a resolution on piloting commercial housing projects through land use agreement or existing land use rights.

Specifically, 169 land plots were found to be ineligible according to the prescribed criteria. The rejected projects failed to conform to land use planning and did not align with the local housing development plan.

Notable mentions include the 21 Sai Dong Residential Area (0.7ha) and the Sai Dong Residential Area (0.2ha) by Vinh Ha Joint Stock Company, which are inconsistent with the N10 urban planning subdivision; and the TC Land Thach Ban Residential Area (1.19ha) by TC Land Real Estate Development Joint Stock Company, as the proposed land plot is listed for land revocation and auction in Long Bien District in 2025, as approved by the City People’s Council in April.

Additionally, the TC Land Ngoc My Residential Area (12.6ha), also by the same company, lacked a basis for consideration due to uncertainty over the area of rice cultivation within the project scope.

The Thanh Thuy Commercial Services and Low-rise Housing Complex (3.5ha) by the Hanoi Southern Gateway Market Joint Stock Company was found to be inconsistent with construction planning; while the expanded Bac Dai Kim Urban Area (7.02ha) by the Hanoi Business and Urban Development Joint Stock Company fell outside the scope of Resolution 171 and involved land-related disputes and complaints.

The Hanoi Department of Agriculture and Environment also invited organizations and individuals to register for the implementation of commercial housing projects under Resolution 171.

The required documents include proof of financial capacity, copies of documents proving existing land use rights, and extracts of maps or diagrams indicating the proposed project site…

Previously, in May, Hanoi approved 148 land plots with a total area of over 840 hectares for the pilot commercial housing projects through land use agreement.

Specifically, the old Long Bien district had 18 projects, the old Hoang Mai district had 13 projects, the old Thanh Xuan district had 12 projects, the old Nam Tu Liem district had 11 projects, the old Dong Anh district had 17 projects, and the old Hoai Duc district had 11 projects…

Most of the projects involve construction of residential areas, including low-rise and high-rise housing, commercial housing, eco-housing, and mixed-use commercial and residential complexes.

Resolution 171 of the National Assembly on piloting commercial housing projects through agreement on land use rights or existing land use rights took effect on April 1st.

This policy will be piloted for 5 years. Previously, companies could only undertake commercial housing projects if they had land use rights for residential land.

For a project to be eligible for the pilot, the land plot must be located in an urban area and have a maximum of 30% of additional residential land area within the planning period (compared to the current land use) according to the provincial land allocation and zoning plan up to 2030.

The resolution stipulates that the pilot will be applied nationwide, covering four groups of eligible projects: 

Projects by real estate businesses that acquire land use rights; Projects by organizations that already have land use rights; Projects that combine existing land use rights with the acquisition of additional land use rights; Projects by real estate businesses established by organizations currently using the land, for the development of commercial housing on the area of production and business facilities that must be relocated due to environmental pollution or in accordance with construction planning and urban planning.
