The Hanoi Department of Agriculture and Environment has recently announced a list of 169 projects that do not meet the criteria to be included in the pilot program as per the National Assembly’s Resolution No. 171/2024/QH15 dated November 30, 2024 (Resolution on piloting the implementation of commercial housing projects through land use agreement or existing land use rights).
This Resolution allows for the development of commercial housing projects through land use agreements or the utilization of existing land.
According to the Hanoi Department of Agriculture and Environment, a total of 169 land projects applied to be piloted under Resolution 171 but failed to meet the specified criteria.
The list includes several large-scale projects. For instance, the Binh Minh urban area, villa and garden project (53.2ha) by Binh Minh Construction and Tourism Corporation was excluded due to exceeding the 20-ha limit for the pilot program.
Similarly, the Thien Duc commercial and residential area (24.3ha) by Tuan Dung Trading Group Joint Stock Company, the Van Dinh residential area (23.6ha) by Ha Tay Building Materials Company, and the Cao Vien residential area (32.5ha) by TSG Vietnam Joint Stock Company were also rejected for the same reason.
The proposed TC Land Thach Ban residential project by TC Land Real Estate Development Joint Stock Company is included in the list of land revocation for auction.
The proposed Sai Dong residential project is inconsistent with the N10 urban planning subdivision; the Khanh Ha eco-residential project in the former Hai Ba Trung District by Luxury Vietnam Real Estate Investment Company is no longer suitable for planning, with a portion of the area overlapping with the proposed location for the city’s social housing complex in the planning block marked C3-1.
Similarly, the Nhi Khe residential area in Thuong Tin District (by DHR International Investment Group Joint Stock Company) and the Eco residential area (by Dong Luc Joint Stock Company) are inconsistent with the planning and overlap with the proposed location for social housing for workers and employees in the Northern Thuong Tin Industrial Park.
Also in Thuong Tin District are the Green Home Dai Ang residential project (by Sapparo Investment Joint Stock Company) and the Cau Van – Thuong Tin residential project (by Truong Thanh Real Estate Investment Joint Stock Company).
Horizon Land Investment Joint Stock Company has projects such as the Horizon Land La Phu residential project, which overlaps with the boundaries of the project for bidding to select investors for projects involving land use…; the Horizon Land Gia Lam residential project, for which the former People’s Committee does not have a participation opinion, therefore lacking sufficient basis for evaluation; and the Horizon Land Hoang Mai residential project…

Earlier, in May and July of this year, Hanoi approved a total of 298 projects to be piloted under Resolution 171.
Resolution No. 171 of the National Assembly, on piloting the implementation of commercial housing projects through land use agreement or existing land use rights, officially took effect on April 1, 2025.
The Resolution stipulates the pilot implementation of commercial housing projects through land use agreements or existing land use rights nationwide in four cases.
Firstly, it applies to projects by real estate business organizations that receive land use rights. Secondly, it includes projects by real estate business organizations that currently hold land use rights. Thirdly, it covers projects by real estate business organizations that hold land use rights and receive land use rights.
Fourthly, it involves projects by real estate business organizations established by land-using organizations to implement commercial housing projects on the area of production and business facilities that need to be relocated due to environmental pollution, facilities that need to be relocated according to construction planning, urban planning, etc.
