“Rethinking Land Valuation for Three BT Contracts in Thu Thiem”

The three construction investment projects: four main roads in the new Thu Thiem Urban Area, Thu Thiem 2 Bridge, technical infrastructure for the northern residential area, and completion of the North-South axis within the new Thu Thiem Urban Area will undergo a comprehensive review. This review will delineate boundaries, pinpoint locations, and determine the land area and land prices for the portions that have been allocated for land handovers or leases to investors as a form of payment.

The Ho Chi Minh City People’s Committee has issued Plan No. 52/Kh-UBND to implement Government Decree No. 91/2025/ND-CP, which regulates the timing of land price determination for land funds used in build-transfer contracts (BT contracts) in the Thu Thiem New Urban Area.

This applies to projects including the construction of four main roads in the Thu Thiem New Urban Area, the Thu Thiem 2 Bridge, and the technical infrastructure of the northern residential area, as well as the completion of the north-south axis within the new urban zone.

As per the plan, from now until August 30, the Ho Chi Minh City Department of Agriculture and Rural Development will review and determine the boundaries, location, area, and land price of the land area with a decision on land allocation or lease, which will be used for payment to investors as stipulated in Clause 1, Article 4 of Decree No. 91/2025/ND-CP.

Simultaneously, they will determine the above for the supplementary land area (if any) and the differential land area. If there are changes in the land fund value after the land price determination, an appendix to the officially signed BT contract will be agreed upon and signed with the investor to update the land fund payment value.

Thu Thiem 2 Bridge is one of the three BT projects subject to scrutiny for land value recalculation for investor compensation.

The Department of Agriculture and Rural Development will also review the issued decisions on land allocation and lease to consider adjustments or supplementary decisions, ensuring compliance with land law regulations.

The Ho Chi Minh City People’s Committee has requested the State Audit Office of Vietnam to conduct an audit in September 2025, encompassing aspects such as verifying the completion value of BT projects, determining the land area and land price of the land fund used for BT project payment, and identifying any differential land area and its corresponding land price as per land law provisions.

The Committee has instructed relevant departments, branches, and the An Khanh Ward People’s Committee to ensure timely execution of the plan. The Department of Finance has been assigned to coordinate with concerned departments, branches, and the An Khanh Ward People’s Committee to monitor, inspect, and urge the implementation of the plan’s contents. They will also synthesize and report progress to the Ho Chi Minh City People’s Committee and advise them on reporting the implementation results of Decree No. 91/2025/ND-CP to the Ministry of Agriculture and Rural Development.

Previously, the Ho Chi Minh City Department of Construction had completed the review of the contents of the abbreviated and officially signed BT contracts for each project. They also verified the investors’ fulfillment of BT project implementation conditions immediately after signing the abbreviated BT contracts, as per Clause 3, Article 3 of Decree No. 91/2025/ND-CP.

The Department of Agriculture and Rural Development has completed the simultaneous land valuation at two time points (the time of signing the abbreviated BT contract and the time of issuing the land allocation decision) for the entire land fund mentioned in the abbreviated BT contracts of the above projects, in accordance with Article 4 of Decree No. 91/2025/ND-CP.
