Pardon is an extraordinary clemency power vested in the State President to decide on early release from prison for prisoners serving definite-term imprisonment, life imprisonment, or death sentences on special occasions or during important national events; it affirms and reflects the humane and tolerant traditions of the Vietnamese people and the lenient policies of the Party and State towards prisoners who show remorse and actively engage in progressive labor reform, hoping for an early pardon to become contributing members of their families and society.
Implementing the State President’s decision on the 2025 pardon (second phase) on the occasion of the 80th National Day (September 2, 2025) and following the guidance of the Advisory Council for Pardon, the inter-sectoral assessment teams of the Advisory Council and the supporting staff of the Council members from various ministries, sectors, and organizations (Ministry of Public Security, Supreme People’s Court, Supreme People’s Procuracy, Government Office, Office of the State President, Central Committee of the Vietnam Fatherland Front, Ministry of Foreign Affairs, Ministry of Defense, etc.) have inspected and assessed over ten thousand eligible profiles for pardon recommendations from prisons and temporary detention facilities under the management of the Ministry of Public Security and the Ministry of National Defense.
The process of reviewing and recommending pardons for eligible individuals is conducted with utmost rigor, openness, democracy, objectivity, fairness, and transparency, ensuring that the right people are considered according to regulations. The profiles for pardon recommendations undergo multiple levels of scrutiny and assessment by various functional agencies and are closely monitored by social organizations and the people.
Speaking at the meeting, Deputy Prime Minister Nguyen Hoa Binh emphasized that following the guidelines of the Party and the State, there have been two pardon phases this year. The first phase was implemented on the occasion of the 50th anniversary of the Liberation of the South and National Reunification (April 30, 1975 – April 30, 2025), and this second phase coincides with the 80th National Day (September 2, 2025).
“Today, we officially convene the Advisory Council for Pardon to review and approve the profiles and list of pardon recommendations for 2025 (second phase). The time left until September 2 is limited, and we have a significant workload. Moreover, after the State President’s decision on the pardon, we need to prepare for the announcement,” said Deputy Prime Minister Nguyen Hoa Binh, outlining the immediate tasks.
Following today’s meeting, the Advisory Council for Pardon will consolidate and submit to the State President the list of prisoners eligible for pardon. This is expected to be the largest-scale pardon in terms of the number of beneficiaries to date.
According to statistics, since 2009, the State President has granted pardon to over 104,000 prisoners on 11 occasions, allowing them to return to their families and communities and become contributing members of society. Notably, the recidivism rate among those pardoned is extremely low. Specifically, for the 2024 pardon, only 5 out of 3,765 pardoned individuals, or 0.13%, have reoffended so far. For the April 30, 2025, pardon (first phase), with a larger number of 8,055 beneficiaries, only 4 individuals, or 0.05%, have reoffended as of now.
